Starting October 1, 2025 the construction contract bidding and contracting process will change per the governor's direction in Executive order 25-64. Bidding firms must now submit certification of compliance with their bid packages to the construction letting email inbox prior the letting closing time. Failure to submit the certification will result in the bid being rejected. You can download the new certification form found here.

Per the recently enacted law IC 8-23-9-0.5 (referencing IC 5-22-15-26), if you are going to claim a pricing preference you must send a completed Price Preference Claim Form and Affidavit of Eligibility to the construction letting email inbox prior to the bid closing date.
Per updated federal court instructions and USDOT/FHWA instructions, the Bidder’s List (aka: Subcontractors Bid Quote) has been updated by removing Gender and Race data fields. Please use the new form as soon as possible. The new form is a requirement beginning with the November 2025 letting. The instructional power point has also been updated.

INDOT will now publish the bid results at 11:30 AM for regular lettings that close at 10:00 AM. Look for real time messages on the bidding pages alerting you if an issue would cause a delay.

All Contractors submitting bids are required to use the DBE Directory to find and verify their DBE contractor’s before uploading their bids. The online Indiana Disadvantaged Business Enterprise (DBE) directory (located here: https://entapps.indot.in.gov/DBELocator/) is the most reliable source for all currently certified Indiana DBEs. Its use is required by the bidding instructions and crucial to utilize towards Good Faith Efforts. To allow ample time for verification of DBE status and DBE credit types, the directory will be frozen at 4:00 p.m. on the Friday before the letting.
Form FHWA-1273 must be incorporated in each construction contract/subcontract funded under Title 23 (excluding emergency contracts solely intended for debris removal). The contractor (or subcontractor) must insert the applicable Form FHWA-1273 in each subcontract (excluding purchase orders, rental agreements, and other agreements for supplies or services).
Electronic posting of Apparent Bid Results on the INDOT webpage has replaced public in-person attendance for the reading of the bids.
Insurance
INDOT construction contracts are now fully electronic. Insurance documents required at the time of contract award shall be submitted as per the instructions in the award letter.

INDOT is now using DocuSign for our contract signings. A DocuSign account is not required, but free accounts are available for persons who expect to be signing multiple contracts. Indiana DBE Directory
Find certified DBEs through the use of the Directory. DBEs may be searched and sorted by company name, NAICS code, DBE category/specialty, INDOT district, and/or DBE code.
Bidder's Lists
In accordance with changes to USDOT rules (49 CFR 26), INDOT is now required to collect certain information for all prime contractors and for any subcontractors who’ve submitted a quote to a prime prior to letting. bidders are now required to submit a Bidder's List (or “Subcontractor Bids Quote”) form to INDOT for each bid submitted. Instructions are contained in the files available below. Required information includes the firm name and address, DBE or non-DBE classification, NAICS codes for work being sought to perform, and age and size of firm. INDOT is required to report this information to the USDOT in December each year.
This reporting form is required to be submitted for a bid to be considered responsive. One complete form per contract shall be submitted no later than 24 h after the time specified in the Notice To Contractors for receipt of bids. This is a requirement of all bidders, not just the low bidder, to maintain eligibility to continue bidder status with INDOT.
The revised 49 CFR Part 26 also created a new type of DBE credit called “Distributor” and clarified the other types of DBE credit available on federal-aid projects. DBE Suppliers shall complete the DBE Supplier Regular Dealer/Distributor Affirmation Form and submit it with their quote to the Contractor. The completed DBE Supplier Regular Dealer/Distributor Affirmation Form shall accompany the firm’s quote when the low bidder on a contract submits the quote to the Department in accordance with RSP 103-C-269.
Changes to INDOT Letting DBE.bin Files
Beginning with the October 8, 2025, INDOT Highway Construction Contracts letting, the DBE.bin files uploaded to Bid Express for each INDOT letting will NOT include firms certified by the State of Kentucky. This is due to changes in the KYTC DBE/ABCBE Directory that prevent the data from being included. KYTC Certified DBE firms may still be entered and used to meet participation goals on INDOT proposals. The KYTC DBE firms will need to be manually entered.
To use a KYTC DBE firm whose name cannot be found in the dropdown list of the Project Bids Bid application, manual enter the DBE as follows. Care will be necessary not to use the dropdown lists for Name, FEIN, address and certification code. These four field dropdowns are linked in the DBE.bin file data. Selecting an entry from the dropdown list for one of these fields will change the other three entries. Otherwise, the steps to complete the entry are the same as a listed firm.
