The Clay County Prosecutor Child Support Division is responsible for the enforcement and collection of court orders for child support for those that have signed up through our IV-D office. The Child Support office also helps establish paternity and establish support and medical orders.

The Pre-Trial Diversion program is a contractual agreement between a Defendant and the Prosecutor. Pre-Trial Diversions are typically offered to defendants who have had little or no criminal background and who are charged with various misdemeanor offenses. The program is ran and supervised by the Prosecutor’s Office.

A typical Pre-Trial Diversion lasts for six months depending on the offense and costs $334.00. If you are accepted into the Diversion Program your case will be dismissed after the agreed upon time period (thereby avoiding a conviction) as long as the requirements and conditions specific to your agreement have been fulfilled.

Per Indiana Code 35-39-8-5, the Prosecutor will not enter into a Pre-Trial Diversion prior to an Initial Hearing if the defendant is not represented by counsel.

Pre-Trial Diversions must be paid in the Clerk’s Office by cashier’s check, money order, cash or credit card (processing fee). NO personal checks accepted and cannot be paid online.

Infraction Deferral paperwork is mailed automatically to persons who qualify on speeding offenses. By entering into an infraction deferral, it allows a driver to avoid points and convictions for traffic tickets on their official driving record.

A typical infraction deferral is a 6 month program that costs $192.50

The Clay County Prosecutor’s Office contacts all victims of charged offenses with a victim packet detailing their rights with paperwork to be returned to our office at the beginning of the case. It is imperative that our office has current contact information for a victim. If you have not been contacted and believe you should please call 812-448-9028.
