The Indiana Department of Education (“IDOE”) will effectuate the provisions of the Americans with Disabilities Act of 1990 (Title II), 28 C.F.R. Part 35, Title VI of the Civil Rights Act of 1964, 34 C.F.R. Part 100, Executive Orders (EO), Section 504 of the Rehabilitation Act of 1973, 34 C.F.R. Part 104, and related nondiscrimination authorities. The IDOE gives public notice of its policy to uphold and assure full compliance with the nondiscrimination requirements of Title VI of the Civil Rights Act of 1964 and related nondiscrimination authorities.
These authorities provide that no person in the United States shall, on the grounds of race, color, national origin, sex, age, disability, or Limited English Proficiency (LEP) be excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimination in IDOE programs and activities. As a recipient of federal financial assistance, the IDOE is committed to nondiscrimination in all its programs and activities whether or not those programs and activities are federally funded.

The IDOE ADA Title II Coordinator is responsible for:
- Coordinating IDOE’s compliance with Title II of the ADA and Section 504 of the Rehabilitation Act in IDOE’s services, programs, and activities available to members of the public;
- Receiving, reviewing, and responding to requests from members of the public for reasonable modifications to IDOE policies, practices, and procedures, and for auxiliary aids and services necessary for effective communication (28 C.F.R. §§ 35.130(b)(7), 35.160);
- Receiving and investigating complaints from members of the public alleging discrimination on the basis of disability in IDOE’s services, programs, or activities, under IDOE’s ADA Title II Grievance Procedure, a copy of which is available from the ADA Title II Coordinator upon request; and
- Maintaining records of requests, grievances, and their resolutions.
