Small Claims Evictions

Before You File

The State of Indiana has prepared the following Handbook to help you better understand the small claims processes in Indiana as well as the guidelines and fees involved.

Small Claims Rules state that the right place to file a small claims suit is the county:

  • where the transaction or occurrence actually took place; or
  • where the obligation or debt was incurred; or
  • where the obligation is to be performed; or
  • where the Defendant resides; or
  • where the Defendant has his or her place of employment at the time the claim or suit is filed.

Small Claims

The Small Claims Court allows people to bring a lawsuit in an informal manner and does not require that they hire an attorney. You may hire an attorney if you choose but it is not required.

Forms are available in the Clerk's office. The Clerk's staff can assist you in filling out the forms, but they cannot give you legal advice.

  • The claim must be for $10,000 or less.
  • The plaintiff must have an address for the Defendant.
  • A filing fee of $125 plus $10 for each additional Defendant must be paid when you file.

Before you file, you must give the tenants a written 10-day notice.

Forms are available in the Clerk's office. The Clerk's staff can assist you in filling out the forms, but they cannot give you legal advice.

  • Bring a copy of the 10-day notice with you.
  • The claim must be for $10,000 or less.
  • The plaintiff must have an address for the Defendant.
  • A filing fee of $125 plus $10 for each additional Defendant, must be paid when you file.
