Introduction
A regional district is an independent local government entity that may be established to provide drinking water, sewers, and solid waste management (trash removal) for homes and businesses within an established service area. The requirements for creating new districts are found in the Indiana Code at IC 13-26. Decisions about forming new districts are made at the local level. IDEM’s administrative role is to ensure districts are formed according to the legal and technical requirements specified in IC 13-26. The formation process begins when IDEM receives a formal petition to establish a district. All interested parties are encouraged to review pending petitions and participate in the review process.

Adams County Regional Sewer District
Summary
Introduction and Background
On September 24, 2009, the Commissioner of the Indiana Department of Environmental Management signed the Order Adopting the Findings of Fact and Recommended Order of the Hearing Officer for the Organization of the Adams County Regional Sewer District (“the District”), in Adams County, Indiana. The Order established the District as an independent political entity of the State of Indiana to provide sewer management for homes and businesses within the established service area.
As described in no. 6 of the Petition to Establish the Adams County RSD, “the need for the proposed district has long been recognized by residents and businesses in the area, also by the Adams County Commissioners, the Petitioner herein, and by the public, generally for the reason that sanitary sewage disposal is provided in the area by each homeowner or business through an on-site septic tank, some of which have failed, or will fail. The absence of public sanitary sewer service has contributed to suppression of development and environmental contamination in the proposed District.”
No. 10 of the petition describes the district territory as, “all that part of Adams County, Indiana, outside of the municipally incorporated areas, as well as areas currently services by CTA’s of such County. Also, any state parks or state-owned lands, such as by the DNR are excluded.”

Allen County Regional Water & Sewer District
Summary
Introduction and Background
On January 16, 1979, the Stream Pollution adopted the Findings of Fact and Recommendations of the Hearing Officer to Establish the Allen County Regional Sewer District (“the District”) in Allen County, Indiana. The Order established the district as an independent political entity of the State of Indiana to provide sewer management for homes and businesses within the established service area.
As described in the Petition, “the need for the proposed district has long been recognized by residents and businesses in the area, also by the Allen County Commissioners, the Petitioner herein, and by the public, generally for the reason that sanitary sewage disposal is provided in the area by each homeowner or business through an on-site septic tank, some of which have failed, or will fail. The absence of public sanitary Water & Sewer service has contributed to suppression of development and environmental contamination in the proposed District.”
On December 12, 1978, the Commissioner of IDEM signed the Order Granting Modification of Allen County Regional Sewer District to increase and add to the District purposes by changing its name to “Allen County Regional Water and Sewer District” and including, as its purposes, to provide a water supply for domestic, industrial, ad public use to users, all inside the territory of the district.
On February 6, 2019, the Commissioner of the Indiana Department of Environmental Management signed the Order Approving the Petition to Release and Abandon Territory and for the Modification of the Final Order Establishing the Allen County Regional Water and Water & Sewer District. This Order released and abandoned certain territories in the Allen County RWSD into the Leo-Cedarville RSD.

Brown County Regional Sewer District
Summary
Introduction and Background
On July 21, 2006, the Commissioner of the Indiana Department of Environmental Management (IDEM) signed the Order Adopting the Findings of Fact and Recommended Order of the Hearing Officer for the Organization of the Bean Blossom Regional Sewer District (“the district”) in Brown County, Indiana. The Order established the district as an independent political entity of the State of Indiana to provide sewer management for homes and businesses within the established service area.
As described in no. 6 of the Petition, “The residents of Bean Blossom and the Brown County Health Department have long recognized the need for the proposed district. Sanitary sewage disposal in Bean Blossom is provided by the use of onsite residential septic systems, in varying degrees of working order… Many Property owners have attempted to repair systems and bring them into compliance with current state and local requirements but are unable to do so due to small lot size or unfavorable soil and/or terrain conditions. This situation has forced some residents to utilize temporary means of disposal until a permanent solution can be found. However, a significant number of residences allow their untreated wastewater to surface discharge because no other option is available to them.”
On December 23, 2013, the Commissioner of IDEM signed the Order Modifying the Order Establishing the Bean Blossom Regional Sewer District requesting the district to add an additional two appointments to District’s Board of Trustees (the Board), for a total of 5 board members, and extended the time to submit its District Plan (see “First Modification”).
On April 17, 2013, the Board voted to include all unincorporated areas of Brown County except the areas serviced by the Helmsburg Regional Sewer District, Gnaw Bone Regional Sewer District, and Cordry Sweetwater Conservancy District (see “Territory Expansion #1”).
On March 22, 2016, the Board voted to change the name of the District to the Brown County Regional Sewer District and petitioned IDEM to amend the Order establishing the District to reflect the name change (see “Second Modification”).
On June 21, 2023, the Board voted to include territory approximately 215 acres located in Monroe County generally including residential properties located along the northeastern end of the Lake Lemon immediately west of the Brown and Monroe County line (see “Territory Expansion #2”).

Bringhurst Regional Sewer District
Summary
Introduction and Background
On May 30, 1980, the Stream Pollution Control Board of the State of Indiana signed the Order creating the Bringhurst Regional Sewer District (“the District”) pursuant to IC 13-26-2-10. The Order established the District as an independent political entity of the State of Indiana to provide sewer management services for homes and businesses within the established service area.
The need for the district as described in no. 3 of the Petition to Establish the Bringhurst Regional Sewer District (“the Petition”) is to, “collect, treat, and dispose of sewage from the residential and commercial area of Bringhurst. The sewage district will serve approximately 100 potential residential dwellings, and 5 businesses or commercial users.”
Further described in no. 5 of the Petition, “With the concentration of the above referenced number of residential dwellings, commercial users, the proposed Regional Sewage District will serve the public interest in that the public health and safety will be enhanced not only within the Regional Sewer District but also any and all areas which are now receiving or come into contact with a drainage district that originate or traverse the proposed Regional Sewer District.”

Borden Tri-County Regional Water District
Summary
Introduction and Background
On February 23, 1976, the Stream Pollution Control Board of the State of Indiana signed the Final Order and Determination for the Organization of the Borden Tri-County Regional Water District (“the District”) to service territories within Clark, Floyd and Washington Counties of Indiana. The district is organized as an independent political entity of the State of Indiana to provide a water supply for domestic, industrial, and public use to users within the district.
As described in no. 4 of the Petition, “the need for the proposed district is to provide a legal entity sufficiently well financed to maintain and, as necessary, replace the physical equipment of the two utilities which are presently providing water supply in the proposed service area, and also to expand and improve the water supply facilities, as necessary, to serve the increasing demand for water in the area.”
No. 5 of the Petition, “the organization of the District will be conducive to the public health, safety, convenience or welfare in that it provides a legal entity which can be both refinance existing debt and finance needed improvements; thus the District enables the people using water in the area to obtain a reliable public water supply instead of relying on two water utilities without adequate financial reserves to maintain and replace equipment as needed, and neither of which have sufficient capital for improvements, extensions and betterments.”

Clay County (Coalmont) Regional Sewer District
Introduction and Background
As described in Clay County (Coalmont) Regional Sewer District’s Petition (no. 7): “The Clay County Commissioners are under an Agreed Order with the Indiana Department of Environmental Management for untreated sewage discharges from the unincorporated community of Coalmont. Numerous on-site septic systems directly discharge to roadside ditches. The discharge of untreated sanitary sewage to any surface waters or ground waters of the state is a violation of Indiana Administrative Code. In addition, based on IDEM’s inspection, many septic systems appear to be unapproved sewage disposal methods along with open sewer laterals discharging directly on the ground and into waters of the State which is a direct violation of 410 IAC 6-8.3-53 and Indiana Code (IC) 13-30-2-1. Additionally, the need for the proposed District has also been recognized by residents, businesses, and elected officials such as the Clay County Commissioners and other members of the public. The absence of public sanitary sewer service is a public health and safety concern in addition to having a negative impact on the value of property within the proposed District.”

On July 7th, 1999, the Commissioner of the Indiana Department of Environmental Management (IDEM) signed the Order creating the Blue River Regional Water District (“the District”) pursuant to IC 13-26-2-10. The Order established the District as an independent political entity of the State of Indiana to provide water management services for homes and businesses within the established service area.
The need for the district as described in no. 4 of the Petition to Establish the Blue River Regional Water District (“the Petition”), “Throughout the proposed District are numerous residents with failing wells and water supplies of questionable quality and quantity. The Town of Marengo has declared an emergency in its municipal water utility due to supply conditions. The Town of Milltown’s municipal water utility has need for additional water supply for its existing customers and for treatment improvements. This action will be conducive to public health, safety and welfare of the citizens of Milltown, Marengo and areas within the proposed district boundaries.”

Dearborn County Regional Sewer District

Introduction and Background
On November 17, 2003, the Commissioner of the Indiana Department of Environmental Management (IDEM) signed the Order Adopting the Findings of Fact and Recommended Order of the Hearing Officer for the Organization of the Dearborn County Regional Sewer District (“the District”) in Dearborn County, Indiana. The Order established the District as an independent political entity of the State of Indiana to provide sewer management for homes and businesses within the established service area.
The need for the District, as described in no. 6 of the Petition to Establish the Dearborn County RSD (“the Petition”), “has long been recognized by residents and businesses in the area and the Dearborn County Commissioners, the Petitioner herein, and the public generally for the reason that sanitary sewage disposal is provided in the area by each homeowner or business through an on-site septic tank, many of which leak, have failed or will fail or by private sewer systems that have failed. The absence of public sanitary sewer service has contributed to suppression of development and environmental contamination in the proposed District.”
The purpose of the District, as described in no. 7 of the Petition is to reduce the, “pollution of the environment by elimination of inadequate septic systems and the construction of a sanitary sewer collection system and appropriate treatment of collected sewage. The proposed Board shall be responsible for the management of the sewer district and the administration of sewer district facilities.”
On January 12, 2006, the Dearborn County RSD board voted to expand the District boundaries to all unincorporated areas county-wide (unserved by municipal providers and the boundaries of the South Dearborn RSD).

Delaware County Regional Waste District
Summary
Introduction and Background
On January 20, 1976, the Stream Pollution Control Board of the State of Indiana signed the Order establishing the Delaware Regional Waste District (“the District”) pursuant to IC 13-26 (formally IC 19-3). The Order established the District as an independent political entity of the State of Indiana to provide sewer management services for homes and businesses within the established service area.
As described in clause 3 of the petition to establish the District:
- “That the purpose to be accomplished by the establishment of said District is to create an entity which is empowered to construct, contract for or otherwise provide facilities in the area to be served for the collection, treatment, and disposal of sewage, and to do those things and possess those powers enumerated in IC 19-3-1.1-1 et. Seq., as supplemented and amended so as to be beneficial to and improve the public health, safety and welfare of Delaware County and the State of Indiana.
- That the need for the District is to eliminate and prevent the pollution of rivers, streams, and creeks and other bodies of water within the boundaries of the District and to make development of the serviced areas of Delaware County possible without unnecessary discharging of untreated or improperly treated effluent into the existing watercourses.
- That the District will protect, enhance and be conducive to the health, safety, convenience and general welfare of the people of Delaware County and the people of the State of Indiana by the elimination and prevention of pollution by sewage effluent of bodies of water located in or running through the District.
- That sewage collection and disposal in the District is currently being provided by private systems and plants and individual septic tanks and soil absorption systems.
- That these current systems are frequently prone to premature failure; and when such malfunctioning systems are not or cannot be repaired, relief is usually accomplished through the illegal drainage of effluent away from residences via connection either directly or indirectly to subsurface storm drains, agricultural drainage tiles, open drainage ditches, creeks, streams or river, thus adding the pollution of the waterways, wells and air of Delaware County.
- That projected development cannot take place in Delaware County without an adequate system for collection, treatment and disposal of sewage.
- That there is no existing indebtedness in the proposed District for the proposed purpose.”

Dubois County Regional Sewer District
Summary
Introduction and Background
On February 15, 2024, the Commissioner of the Indiana Department of Environmental Management (IDEM) signed the Order Adopting the Findings of Fact and Recommended Order of the Hearing Officer for the Establishment of the Dubois County Regional Sewer District (District).
As described in the district’s Project 1 – Phase 1 Executive Summary, “Dubois County is seeking to establish a new Regional Sewer District to address failing septic systems. Many small communities throughout the County are facing similar issues with failing septic systems resulting in untreated domestic waste pollution to nearby waterbodies. Many of these areas with failing septic systems are facing high capital costs for replacement and are located in areas of soil conditions that are not favorable for the installation of septic systems as a long-term solution.”

Elkhart County Regional Sewer District

Introduction and Background
On November 4, 2004, the Commissioner of the Indiana Department of Environmental Management (IDEM) signed the Order Adopting the Findings of Fact and Recommended Order of the Hearing Officer for the Organization of the Elkhart County Regional Sewer District (the District) in Elkhart County, Indiana. The Order established the district as an independent political entity of the State of Indiana to provide sewer management for homes and businesses within the established service area.
As described in no. 7 of the Petition to Establish the Elkhart County RSD (the Petition), “The need for the proposed District has long been recognized by the residents and businesses in the area, by the Elkhart County Commissioners, the Petitioner herein and the public generally for the reason that sanitary sewage disposal is provided in the area by each homeowner or business through an on-site septic tank, many of which leak, have failed or will fail. The absence of public sanitary sewer service has contributed to suppression of development and environmental contamination in the proposed District.”
As described in no. 8 of the Petition, “The purpose to be accomplished by the formation of the District is the reduction of pollution of the environment by elimination of inadequate septic systems and the construction of a sanitary sewer collection system and appropriate treatment of collected sewage.”
In May of 2010, the Elkhart County Commissioners applied to include additional territory into the District expanding the District’s service area to the whole county of Elkhart (see Notification of Territory Expansion #1).
On July 20, 2015, the Commissioner of IDEM signed the First Order Modifying the Order forming the Elkhart County RSD increasing the District’s Board of Trustees (the Board) from five (5) to eleven (11) member board.

On August 13, 1992, the Commissioner of the Indiana Department of Environmental Management (IDEM) signed the Order establishing the Everton Regional Sewer District (“the District”). Borden Tri-County Regional Water District

Introduction and Background
On February 23, 1976, the Stream Pollution Control Board of the State of Indiana signed the Final Order and Determination for the Organization of the Borden Tri-County Regional Water District (“the District”) to service territories within Clark, Floyd and Washington Counties of Indiana. The district is organized as an independent political entity of the State of Indiana to provide a water supply for domestic, industrial, and public use to users within the district.
As described in no. 4 of the Petition, “the need for the proposed district is to provide a legal entity sufficiently well financed to maintain and, as necessary, replace the physical equipment of the two utilities which are presently providing water supply in the proposed service area, and also to expand and improve the water supply facilities, as necessary, to serve the increasing demand for water in the area.”
No. 5 of the Petition, “the organization of the District will be conducive to the public health, safety, convenience or welfare in that it provides a legal entity which can be both refinance existing debt and finance needed improvements; thus the District enables the people using water in the area to obtain a reliable public water supply instead of relying on two water utilities without adequate financial reserves to maintain and replace equipment as needed, and neither of which have sufficient capital for improvements, extensions and betterments.”

Brookville Regional Waste District

On May 30, 1980, the Stream Pollution Control Board of the State of Indiana signed the Order creating the Brookville Regional Waste District (“the District”) pursuant to 13-26-2-10. The Order established the district as an independent political entity of the State of Indiana to provide sewer management services for homes and businesses within the established service area.
The need for the district as described in no. 3 of the Petition to Establish the Brookville Regional Waste District (“the Petition”), “That construction of the dam which will create the Brookville Reservoir, which reservoir will extend from approximately at Brookville, Indiana, north a distance of nearly seventeen (17) miles is now essentially complete, and impoundment of water has begun. This lake is being formed through drainage from the watershed area of the east fork of the Whitewater River. Most of the area surrounding said lake and in said watershed area is rural and agricultural in nature. The only incorporated town in the area to be contained in said Brookville Lake Regional Waste District, and in the largest concentration of population therein, is the Town of Liberty, Indiana, with a population of approximately 2,000 people. Practically all sewage treatment in said area is now done through individual septic tanks, with the exception that the Town of Liberty, Indiana, has a treatment plant. Affluent from the treatment plant at Liberty, Indiana flows into the east fork of the Whitewater River. Residential, recreational, and commercial development near and around said lake is expected to be both rapid and intense and in order to avoid pollution of the lake and properly provide for an orderly development, establishment of a regional sewer district for the area around said lake is essential. The purpose of the regional waste district will be to provide for the collection, treatment, and disposal of sewage within and outside the district.”

On February 27, 2023, the Commissioner of the Indiana Department of Environmental Management (IDEM) signed the Order Adopting the Findings of Fact and Recommended Order of the Hearing Officer for the Establishment of the Hamilton County Regional Utility District (District).
As described in the District’s petition no. 11, “Hamilton County government, residents, and businesses have recognized the need for the District to provide water (both potable water and water for fire protection service) and sewer services in the area. On November 30, 2000, the Commissioner of the Indiana Department of Environmental Management signed the Order Adopting the Findings of Fact and Recommended Order of the Hearing Officer for the Organization of the Arlington Regional Water and Sewer District (District) in Huntington County, Indiana.
As described in the District Petition to Establish the Arlington Regional Water and Sewer District (Petition), “The need for the proposed District has long been recognized by residents of the area, by Huntington County, and the public general. The immediate purpose to be accomplished is the acquisition and operation of an inadequate water and sewer utility presently owned by Arlington Utilities, Inc. In addition, the District will provide water and sewer service to presently undeveloped property within the proposed District, which property would be unsuitable for private septic systems and wells. The District will be conducive to public health, safety, convenience and welfare for the following reasons, among others:
(a) providing adequate supply of portable water to residents of the District;
(b) providing for the safe and environmentally sound treatment of sewage; and
(c) encouraging growth and economic development in the District. The provision of water and sewer collection, disposal and treatment is currently being provided, as noted previously, by Arlington Utilities, Inc., which is presently providing inadequate service and is under investigation before the Indiana Utility Regulatory Commission…The existing situation creates and adds to pollution or health hazards or impedes development in the area.”

Bippus Regional Sewer District

On October 6, 1997, the Commissioner of the Indiana Department of Environmental Management (IDEM) signed the Order creating the Bippus Regional Sewer District (“the District”) pursuant to IC 13-26-2-10. The Order established the District as an independent political entity of the State of Indiana to provide sewer management services for homes and businesses within the established service area.
The purpose to be accomplished by the district as described in no. 5 of the Petition to Establish the Bippus Regional Sewer District (“the Petition”) is to, “create the organization by which the presently existing inadequate wastewater disposal and treatment facilities can be upgraded to provide for proper sewage treatment and disposal. This entity would also provide the necessary organization for funding, operation, maintenance and future oversight of the proposed improvements. The proposed improvements would accomplish two main goals:
- The sewage treatment facilities proposed would eliminate and alleviate the present inadequate wastewater treatment systems in the Town of Bippus. The present systems are not providing adequate treatment of wastewater which has resulted in contamination of local county drains, and a high risk for contamination of well water. Creation of a community wastewater treatment facility would eliminate the need for individual on-site wastewater treatment systems which are the cause of the existing and potential public health and safety problems identified hereinabove.
- Provide a wastewater treatment facility which would allow for future growth of the Town of Bippus. Presently, individual, on-site wastewater treatment systems are the only option available in the Town of Bippus. Because of lot sizes and soil types, as described above, such individual on-site wastewater treatment systems are, and will continue to be, inadequate for proper wastewater treatment. The Huntington County Sanitarian and the Huntington County Health Department cannot issue new permits for individual on-site wastewater treatment systems as these systems cannot be safely utilized. Without a modification of the presently existing wastewater treatment facilities, the Town of Bippus will not grow and no new development can occur there.”

On May 22, 2001, the Commissioner of the Indiana Department of Environmental Management (IDEM) signed the Order creating the Dawn Lakes Regional Sewer District (“the District”) pursuant to IC 13-26-2-10. The Order established the District as an independent political entity of the State of Indiana to provide sewer management services for homes and businesses within the established service area.
The need for the district as described in section “C” of the Petition to Establish the Dawn Lakes Regional Sewer District (“the Petition”), “has long been recognized by the residents of the area, by Huntington County, and the public general. The immediate purpose to be accomplished is the operation of a previously inadequate sewer utility presently owned by the Dawn Lakes Estate Home Owner Association Inc. In addition, the District will provide sewer service to presently undeveloped property within the proposed District, which property would be unsuitable for private septic systems. The District will be conducive to public health, safety, convince and welfare for the following reasons, among others:
- Providing for the safe, environmentally sound, and proper treatment of sewage;
- Providing for financially feasible opportunities for improvements to the sewage collection infrastructure and treatment systems; and
- Encouraging growth and economic development in the proposed District.
The proposed District’s current provision for sewage collection and treatment is being provided, as noted above, by Dawn Lakes Estate Home Owner Association Inc., which recently acquired the utility from a private utility operator, Dawn Lakes Utilities, L.L.C., which was previously under investigation for inadequate service and environmental pollution by the Indiana Utility Regulatory Commission, the Indiana Office of the Utility Consumer Counselor, and the Indiana Department of Environmental Management. There is no outstanding indebtedness for the purposes planned in the proposed District. The existing situation could create and/or add to pollution or health hazards or impede development in the area.”

Geneva Township Regional Sewer District (DISSOLVED)

Introduction and Background
On January 20, 1976, the Stream Pollution Control Board of the State of Indiana signed the Order creating the Geneva Township Regional Sewer District (“the District”) pursuant to IC 13-26-2-10. The Order established the District as an independent political entity of the State of Indiana to provide for the collection and disposal of sewage in Geneva Township and a portion of Center Township, Jennings County, Indiana.
On August 28, 1996, IDEM received a letter from Don Broadus, former President of the District, stating that the district had been inactive for years and persons interested in the operation of the District have retired, moved out of the District, or are now deceased. Corinne R. Finnerty, attorney last representing the District, also sent IDEM a letter on May 10, 1995, stating that the District was defunct and never acted on its intended purpose of providing sewer service.
In 1995, the Jennings County Commissioners petitioned IDEM to form a regional sewer and water district, Jennings Northwest Regional Utilities, and proposed to serve the territory of Geneva Township RSD.
On October 29th, 1996, the Commissioner of IDEM signed the Order for the dissolution of the Geneva Township RSD pursuant to IC 13-26-6-4.

As described in the Petition no. 8, “The need for the proposed District has long been recognized by residents and businesses in the area, and by the Knox County Commissioners, the Petitioner herein and the public generally for the reason that water distribution and sanitary sewage disposal is provided in the area by each homeowner or business through an on-site septic tank, many of which leak, have failed, or will fail. The absence of public sanitary sewer service has contributed to the suppression of development, public health hazard, and environmental contamination in the proposed District, as demonstrated in the letters of support for the project.”

On October 18, 1977, the Stream Pollution Control Board of the State of Indiana adopted the Findings of Fact and Recommended Order establishing the Turkey Creek Township Regional Sewer District (District)
As described in no. 4 of the District Petition, “the purpose to be accomplished by the Sewage District is to provide a means in the area to be served by a sewer district for the collection, treatment and disposal of sewage so as to be beneficial to and improve the public health, safety and welfare in the area and to promote the improvement of the water quality of Lake Wawasee, Syracuse Lake, and Turkey Creek.”
In February 2014, the District submitted the Turkey Creek Regional Sewer District Plan which outlines in the Introduction that, “Turkey Creek Regional Sewer District was originally created by order of the Indiana Stream Pollution Control Board on October 18, 1977. The original purpose was to provide sewer service in the service territory defined. The original purpose was added to on October 27, 1987, by order of the Indiana Stream Pollution Control Board to include water service. The District then acquired the sewer and water infrastructure of the Wawasee Sewer and Water Company, Inc. The Turkey Creek Regional Sewer District is now established to provide both water and sewer service within the service territory defined.”
On March 3, 2021, the Commissioner of the Indiana Department of Environmental Management signed the Order Modifying the Final Order Establishing the Turkey Creek Regional Sewer District to Update the District’s Territory Description and to Limit the District’s Powers Regarding that Territory.

The need for the District was stated in the Petition to Establish the District, “has long been recognized by residents of the area by Lake County, and the public generally. The purpose to be accomplished is the upgrade of an inadequate sewer and water systems. It will be conducive to the public health, safety, convenience and welfare for the following reasons:
- Watermain breaks causing public fire protection problems.
- Inadequate water pressure system for residents.
- Inadequate water availability for the public.
- Non compliance of effluent quality from Wastewater Treatment Plant.
- Overflows from lift station into Lake Dalecarlia.”

On November 19, 1974, the Stream Pollution Control Board of the State of Indiana signed the Order adopting the Findings of Fact and Recommended Order establishing the Anderson Township Regional Sewer District (District) in Rush County, Indiana. The Order established the district as an independent political entity of the State of Indiana to provide sewer management for homes and businesses within the established service area.
As described in the Petition from 1988, “(4b) The purpose to be accomplished by the Regional Waste District is to provide a means for the collection, treatment and disposal of sewage within the proposed area so as to improve public health, safety and welfare.” The method used to discharge sewage in this community at the time of the Petition mainly consisted of, “(4c) raw sewage onto the open surface or septic tank systems, but due to the permeability of the soil the sewage is not absorbed into the soil. (4e) The area proposed to be served by the Regional Waste District is experiencing an increase in population. Soil conditions are such that percolation is very limited and almost all sewage ends up on top of ground in ditches, along roadways and in creeks. A serious health hazard does exist because of inadequate facilities and because of soil conditions.”

On May 30, 1980, the Stream Pollution Control Board of the State of Indiana signed the Order creating the Brookville Regional Waste District (“the District”) pursuant to 13-26-2-10. The Order established the district as an independent political entity of the State of Indiana to provide sewer management services for homes and businesses within the established service area.
The need for the district as described in no. 3 of the Petition to Establish the Brookville Regional Waste District (“the Petition”), “That construction of the dam which will create the Brookville Reservoir, which reservoir will extend from approximately at Brookville, Indiana, north a distance of nearly seventeen (17) miles is now essentially complete, and impoundment of water has begun. This lake is being formed through drainage from the watershed area of the east fork of the Whitewater River. Most of the area surrounding said lake and in said watershed area is rural and agricultural in nature. The only incorporated town in the area to be contained in said Brookville Lake Regional Waste District, and in the largest concentration of population therein, is the Town of Liberty, Indiana, with a population of approximately 2,000 people. Practically all sewage treatment in said area is now done through individual septic tanks, with the exception that the Town of Liberty, Indiana, has a treatment plant. Affluent from the treatment plant at Liberty, Indiana flows into the east fork of the Whitewater River. Residential, recreational, and commercial development near and around said lake is expected to be both rapid and intense and in order to avoid pollution of the lake and properly provide for an orderly development, establishment of a regional sewer district for the area around said lake is essential. The purpose of the regional waste district will be to provide for the collection, treatment, and disposal of sewage within and outside the district.”

The need for the district as described in no. 4 of the Petition to Establish the Crown Hill Regional Sewer District (“the Petition”), “is to furnish sanitary sewers to a rapidly developing area of Clinton Township Vermillion County, Indiana, outside the corporate limits of the City of Clinton, Indiana not presently being served by a sanitary sewer. The proposed district will install sewers in such area with the sewage to be treated by the Sewage Treatment Plant in the City of Clinton, Indiana. The businesses and residences in the proposed area presently use septic or mound systems for disposal of sewage in a soil that is not particularly conducive to such systems resulting in potential for hazards to the public health because of operational difficulties with such systems.”

Borden Tri-County Regional Water District

On February 23, 1976, the Stream Pollution Control Board of the State of Indiana signed the Final Order and Determination for the Organization of the Borden Tri-County Regional Water District (“the District”) to service territories within Clark, Floyd and Washington Counties of Indiana. The district is organized as an independent political entity of the State of Indiana to provide a water supply for domestic, industrial, and public use to users within the district.
As described in no. 4 of the Petition, “the need for the proposed district is to provide a legal entity sufficiently well financed to maintain and, as necessary, replace the physical equipment of the two utilities which are presently providing water supply in the proposed service area, and also to expand and improve the water supply facilities, as necessary, to serve the increasing demand for water in the area.”
No. 5 of the Petition, “the organization of the District will be conducive to the public health, safety, convenience or welfare in that it provides a legal entity which can be both refinance existing debt and finance needed improvements; thus the District enables the people using water in the area to obtain a reliable public water supply instead of relying on two water utilities without adequate financial reserves to maintain and replace equipment as needed, and neither of which have sufficient capital for improvements, extensions and betterments.”
