Lake/Porter Counties 2008 8-Hour Ozone Status

U.S. EPA redesignated Lake County and Porter County as attainment for the 2008 8-hour ozone standard, effective May 20, 2022. The final rule is published in the Federal Register at 87 FR 30821. On September 15, 2022, the Environmental Rules Board issued an emergency rule update to the state rules at 326 IAC 1-4 adopting the U.S. EPA’s designations of attainment for the 2008 8-hour ozone standard for Lake and Porter Counties.

Volatile organic compounds (VOC) and nitrogen oxides (NOx) are regulated under the federal Clean Air Act for the purposes of attaining and maintaining the ozone standards. VOC and NOx emissions must be considered when evaluating rule applicability relating to ozone. VOC and NOx emissions must be evaluated pursuant to requirements of Emission Offset in state rule at 326 IAC 2-3 .

A rulemaking process has begun to adopt into state rule U.S. EPA’s attainment designations for Lake and Porter Counties under the 2008 8-hour ozone standard. The public can view rulemaking notices and actions for the Air Pollution Control Division of the Environmental Rules Board.
