Certificate of Need Program

The new Certificate of Need program became effective on July 1, 2019, for Indiana comprehensive care facilities (nursing homes). The Certificate of Need program is the result of Senate Enrolled Act 190 from the 2018 session of the Indiana General Assembly.

Review Process and Timeline for Certificate of Need

The review process will occur every year and begin on July 1 and last until the following June 30.  The law sets out the review period as follows:

July 1IDOH will publish the results of the county by county need formula before July 1.
July 31Certificate of Need applications will be accepted through July 31.
August 15IDOH will publish submitted Certificate of Need applications by August 15.
October 15IDOH will accept public comments on submitted Certificate of Need applications through October 15.
April 30Any decision on an accepted Certificate of Need will be made no later than April 30.

Certificate of Need applications must be received by July 31 and be accompanied by all information required in the application, including a non-refundable $5,000 application fee.
