Proposed changes to Certification Rules LSA #21-523

Subject of proposed rulemaking: 590 IAC 5 Librarian Certification

Summary of Proposed Rule: Replaces the rule on definitions (590 IAC 5-1) with a new rule (590 IAC 5-1.1) that puts definitions into alphabetical order and removes unnecessary definitions. Eliminates the list of specific topics a person must take library science courses in to qualify for a Librarian Certificate (LC) 4 or LC 5.  Eliminates Specialist Certificates but allows a person who currently holds a Specialist Certificate to renew it under certain circumstances. Makes several changes to continuing education requirements, including: (1) eliminates requirement a person earn at least 20 Technology Librarian Education Units (TLEUs) per 5-year period, (2) allows a new employee to earn LEUs for training that takes place after the person begins a new position and before the person’s initial permit or certificate is issued, (3) Allows library professionals to earn LEUs for attending escorted library tours, and (4) requires a librarian to keep LEU records for 90 days from the date the certificate expired or the date the certificate was renewed, whichever is later. Specifies which levels of Librarian Certificate a director of a library serving a population of 3,000 or less may hold. Eliminates language that appears to allow a person earning an LC 7 to take three college level library science courses instead of having 3 years of experience in the position.

Repeals: 590 IAC 5-1, 590 IAC 5-4-8, 590 IAC 5-4-9, 590 IAC 5-4-10, 590 IAC 5-4-11, and 590 IAC 5-4-12.

Effective: January 1, 2023

This timeline is anticipatory and subject to change.

The attorney general has 45 days from the date that an agency submits or resubmits a rule pursuant to IC 4-22-3-32.

The governor has 15 days from the date of rule submittal to approve or disapprove the rule. However, the governor may take 30 days to approve or disapprove the rule if the governor files a statement with the publisher within the first 15 days after rule submittal that states that the governor intends to take an additional 15 days to approve or disapprove the rule pursuant to IC 4-22-2-34.

Rule becomes effective 30 days after filing with the Publisher, unless a later effective date is specified in the rule, pursuant to IC 4-22-2-26.
