Workers

Charity Gaming Workers

Workers are members of a qualified organization who helps or participates in conducting or assisting in conducting an allowable activity IC 4-32.3-2-40, including but not limited to: 68 IAC 21-8-19

  1. Selling pull-tabs, punchboards, and tip boards;
  2. Selling bingo supplies;
  3. Dealing cards at a card game other than a qualified card game;
  4. Selling tickets or chances to an allowable activity;
  5. Redeeming a pull-tab, punchboard, or tip board valued at fifty dollars ($50) or less

To be a worker:

  • The individual must be a member of the qualified organization for at least thirty (30) days before the allowable activity. (Or meet an exception.) IC 4-32.3-5-14 (a)
  • The individual must be eighteen (18) years of age. IC 4-32.3-5-17 (a)(2) and 68 IAC 21-10-9 (e)
  • The individual cannot have been convicted of a felony within ten (10) years. IC 4-32.3-5-7

Exception to membership requirement for a worker:

  • The individual is a full-time employee of the qualified organization that is conducting the allowable activity. IC 4-32.3-5-14 (c)
  • The individual is a member of another qualified organization and the individual's participation is approved by the commission. (Nonmember Participation Approval, Form CG-NPA) IC 4-32.3-5-14 (c)
  • The individual is serving as a Volunteer Ticket Agent (VTA) through a retail establishment and approval was obtained by the commission. IC 4-32.3-5-22

A worker may never participate in charity gaming activities on the same day that they served as a worker. IC 4-32.3-5-11 (a)

Exception:

  1. IC 4-32.3-5-11 (d) Bingo Events: A worker at a bingo event:
    1. whose duties are limited to:
      1. selling bingo supplies;
      2. selling tickets/chances for a drawing conducted at the bingo event; or
      3. the duties described in both clauses (A) and (B);
    2. who has completed all of the worker's duties before the start of the first bingo game of the bingo event;
    3. who is not engaged as a worker at any other time during the bingo event;

    may participate as a player in any gaming activity offered at the bingo event following the completion of the worker's duties at the bingo event.

  2. IC 4-32.3-5-11 (c) Festival Activity: A worker at a festival may participate as a player in any gaming activity offered at the festival except as follows:
    1. a worker may not participate in any game during the time in which the worker is conducting or helping to conduct the game.
    2. a worker who conducts or helps to conduct a pull tab, punchboard, or tip board event during a festival activity may not participate as a player in a pull tab, punchboard, or tip board activity conducted on the same calendar day.
