Timeframes and Fees

On April 20, 2023, Indiana Governor Eric J. Holcomb signed Public Law 23-25 (Senate Enrolled Act No. 155), which requires, under SECTION 2, that the Environmental Rules Board (ERB) adopt rules to raise two Title V operating permit program fees, increasing: (1) the annual fee for a Part 70 permit to $6,100 (base fee) plus $52.38 per ton for each regulated air pollutant emitted; and (2) the annual fee for a Federally Enforceable State Operating Permit (FESOP) to $6,100; beginning with the fees first due and collectable after December 31, 2023.  Public Law 23-25, SECTION 2, became effective on July 1, 2023, and was enacted as Indiana Noncode Statute 2023-25-2.  Increases to annual fees for Title V and FESOP sources will be reflected on the annual fee invoice to be sent out in January 2024.

Title V and FESOP annual fees in 326 IAC 2-1.1-7 have been updated effective December 6, 2023.

* If a public hearing is held for a permit, then an additional 45 days is added to the Statutory Deadline timeframe.

** A transition is a move from one permit type to another, based solely on a Permittee's choosing. A transition does not include physical and operational change, modification, or new construction. If a Permittee plans physical and operational change, modification, or new construction that requires a different level of permit, IDEM will issue a New Source Review/Construction Permit of the new Permit level. The deadline, Public Notice, proposal to U.S. EPA, and base fee are all determined by the New Source Review/Construction Permit.

Part 70;

  • Limited to not more than $238,125 per year; or
  • Limited to not more than $317,500, if a source emits more than 100 tons per year of NOx, emits more than 100 tons per year of VOC, and is located in an area designated as serious or severe nonattainment for ozone in accordance with the Clean Air Act.
  • The annual fee calculation excludes the amount of a Part 70 source's actual annual emission of each regulated air pollutant that the source emits in excess of 4,000 tons per year.
