IDEM’s Position on the U.S. Supreme Court Ruling in Utility Air Regulatory Group v. Environmental Protection Agency
IDEM is providing this guidance document concerning the Tailoring Rule [ZIP] to assist permittees in determining IDEM’s position on Greenhouse Gas (GHG) permitting in light of the Supreme Court decision on the Tailoring Rule. This guidance may not be appropriate for all situations, and IDEM retains the discretion to approach individual issues differently than provided in the guidance document. This guidance does not change any applicable rule or law.
