  PLEASE NOTE: Employees may work on their application receipt for up to ninety (90) days from the date of the receipt while waiting for an employee permit to be issued.

  
  Types of Employee Permits:

  • Employee Permit (Bartender, Waiter/Waitress, or Sales Clerk):
    • IC 7.1-3-18-9(a): The Commission may issue an employee's permit to a person who desires to act as: (1) a clerk in a package liquor store; (2) an employee who serves wine at a farm winery; or (3) a bartender, waiter, waitress, or manager in a retail establishment (excepting dining car and boat employees); and (4) an employee of a licensed beer dealer or liquor dealer to deliver beer or liquor.
  • Restricted Employee Permit (19 & 20 Year Olds)
    • A person who is at least nineteen (19) years of age but less than twenty-one (21) years of age and who has successfully completed an alcohol server training program certified by the Commission may serve alcoholic beverages in a dining area or family room of a restaurant or hotel only while under the supervision of a person who: (i) is at least twenty-one (21) years of age; (ii) is present at the restaurant or hotel; and (iii) has successfully completed an alcohol server training program certified by the Commission.
    • Employees with a restricted employee permit issued by the Commission may not serve alcoholic beverages in a bar area or act as a bartender.
  • Volunteer Employee Permit:
    • IC 7.1-3-18-9(e): An applicant may declare on the application form that the applicant will use the employee's permit only to perform volunteer service that benefits a nonprofit organization. It is unlawful for an applicant who makes a declaration under this subsection to use an employee's permit for any purpose other than to perform volunteer service that benefits a nonprofit organization.

  OWI Convictions

  • Pursuant to IC 7.1-3-18-9, the Commission may not issue an employee permit to an applicant who:
  • is currently serving a sentence for a conviction for operating while intoxicated (including any term of probation or parole).
  • has two (2) unrelated convictions for operating while intoxicated, if:
    • the first conviction occurred less than ten (10) years before the date of the application for the permit; and
    • the applicant completed the sentence for the second conviction (including any term of probation or parole) less than two (2) years before the date of the application for the permit.
  • has at least three (3) unrelated convictions for operating while intoxicated in the ten (10) years immediately preceding the date of the application for the permit, unless, in the ten (10) years immediately preceding the date of the application, the applicant has:
    • one (1) conviction for operating while intoxicated, and the applicant is not currently serving a sentence for a conviction for operating while intoxicated (including any term of probation or parole); or
    • two (2) unrelated convictions for operating while intoxicated, the applicant is not currently serving a sentence for a conviction for operating while intoxicated (including any term of probation or parole), the first conviction occurred more than ten (10) years prior to the date of the application, and the applicant completed the sentence for the second conviction (including any term of probation or parole) more than two (2) years prior to the date of the application.
