FED-01 - Summary of Federal Requirements - NSPS & NESHAP

The purpose of FED-01 is to summarize the federal requirements that apply to the source. FED-01 is a required form and shall be submitted to IDEM, OAQ whenever federal rule requirements are to be included in an air permit. Use one FED-01 form for each federal rule that applies to the source. For the purposes of this form, the term “source” refers to the plant as a whole and NOT to the individual emissions units.

Part A: Identification of Applicable Standard

Part A identifies the applicable standard and affected source.

  1. Type of Standard: Specify the type of federal rule that is applicable to the source.
  2. Subpart Letter: Specify the subpart letter for the federal rule that is applicable to the source.
  3. Source Category Name: Specify the source category name for the federal rule that is applicable to the source. This is also the title of the federal rule.
  4. Affected Source(s): Identify all processes that comprise the affected source for the applicable federal rule.
    • Note: An "affected source" is defined in 40 CFR 63.2 of the General Provisions as the stationary source, the group of stationary sources, or the portion of a stationary source that is regulated by a relevant standard or other requirement established pursuant to Section 112 of the Clean Air Act. Typically, each MACT standard defines the applicability of the affected source within the first few regulatory sections of the final rule. A list of all the Part 63 NESHAPs (MACT standards) are available on the U.S. EPA website.
  5. Initial Compliance Date: Specify when the source plans to comply with the federal rule. The rule will specify the initial compliance deadline based on the status of the source in question.
    • For each item listed in Sections B-D, identify the section of the Standard that is applicable at the lowest subsection level. For example, if all of 40 CFR 63.342(c) is applicable, "40 CFR 63.342(c)" is the appropriate citation. If only paragraph 2 of 40 CFR 63.342(c) is applicable, then the appropriate citation is 40 CFR 63.342(c)(2).

Part B: Emissions Limitations and Standards

Part B identifies those requirements that would be included in the operating permit as emission limitations and standards.

  1. Emission Limits: Specify the applicable emission limits by identifying the applicable section(s) of the rule at the lowest subsection level or state that there are no applicable requirements.
  2. Work Practice Standards: Specify the applicable work practice standards by identifying the applicable section(s) of the rule at the lowest subsection level or state that there are no applicable requirements.
  3. Operation and Maintenance Plan: Specify the applicable requirement by identifying the applicable section(s) of the rule at the lowest subsection level or state that there are no applicable requirements.
  4. Start-up, Shutdown, Malfunction Plan: Specify the applicable requirement by identifying the applicable section(s) of the rule at the lowest subsection level or state that there are no applicable requirements.
  5. Monitoring to Demonstrate Continuous Compliance: Specify the applicable monitoring requirements by identifying the applicable section(s) of the rule at the lowest subsection level or state that there are no applicable requirements.

Part C: Compliance Determination Requirements

Part C identifies those requirements that would be included in the operating permit as compliance determination requirements.

  1. Performance Testing: Specify the applicable performance testing requirements by identifying the applicable section(s) of the rule at the lowest subsection level or state that there are no applicable requirements.
  2. Date of Initial Performance Test: Specify when the source plans to conduct the initial performance test to demonstrate compliance with the federal rule. The rule will specify guidelines for when this test should occur.
  3. Test Methods: Specify the applicable test methods by identifying the applicable section(s) of the rule at the lowest subsection level or state that there are no applicable requirements.
  4. Was the initial performance test approved by IDEM? Specify whether the initial performance test was approved by IDEM, and provide the date the approval was issued.
  5. Did the initial performance test show compliance with the rule? Specify whether the initial performance test showed compliance with the rule, and if compliance has not been demonstrated, provide the date of the next performance test.

Part D: Record Keeping and Reporting Requirements

Part D identifies those requirements that would be included in the operating permit as record keeping and reporting requirements.

  1. Record Keeping Requirements: Specify the applicable record keeping requirements by identifying the applicable section(s) of the rule at the lowest subsection level or state that there are no applicable requirements.
  2. Notification Requirements: Specify the applicable notification requirements by identifying the applicable section(s) of the rule at the lowest subsection level or state that there are no applicable requirements.
  3. Date Initial Notification was Submitted: Specify when the source submitted the initial notification of applicability of the federal rule. The rule will specify guidelines for when this notification is due to IDEM and the U.S. EPA.
  4. Reporting Requirements: Specify the applicable reporting requirements by identifying the applicable section(s) of the rule at the lowest subsection level or state that there are no applicable requirements.

Part E: Other Information

Part E identifies any additional information pertaining to the applicable federal rule. Attach additional information using form GSD-09 as necessary.

Submission of Confidential Records

All information submitted to IDEM will be made available to the public unless it is submitted under a claim of confidentiality. Claim of confidentiality must be made at the time the information is submitted to IDEM, and must follow the requirements set out in 326 IAC 17.1-4-1. Failure to follow these requirements exactly will result in your confidential information becoming a public record, available for public inspection.
