Application Instructions for Marion Superior Court Vacancy

The Marion County Judicial Selection Committee is beginning the process of selecting two new superior court judges. Judge James Osborn (Court 21, Criminal Division) will retire effective October 1, 2026, and Judge Gary Miller’s term (Court 20, Criminal Division) will end effective December 31, 2026, creating two vacancies on the Marion Superior Court.

Pursuant to Ind. Code § 33-33-49-13.4(d), “In no event may more than fifty-two percent (52%) of the judges serving on the Marion superior court be members of the same political party.” The current vacancies on the Marion Superior Court are one Republican and one Democrat.

Application materials and letters of recommendation are due Friday, August 7, 2026, at 12:00 p.m. (Eastern).

Candidates should prepare their application materials to be submitted electronically through the Indiana Courts Portal using the "Upload a document feature." If you are not sure how to sign in, see the help topic on signing in or creating an account.

Please sign into the portal well in advance of submitting your application in case you need assistance with your login or password. Do not wait until the final submission day to sign into the portal.

After the application deadline passes, the Committee will publicly announce the names of all candidates for the vacancy. Applications of candidates for judicial appointment are public records.

Eligibility

To be qualified to serve as a judge of the Marion Superior Court, a person must be a resident of Marion County (at the time of application and throughout the term of office) and be an attorney admitted to the bar of Indiana for at least five years. Ind. Code § 33-33-49-6.

Instructions for electronic application

The electronic copy of your application must be submitted through the Indiana Courts Portal by the deadline above. To apply for the position, you should submit five files through the Indiana Courts Portal using the "Upload a document" feature. Files must not exceed 15 MB in size.

Sign into the Indiana Courts Portal at portal.courts.in.gov. From the dashboard, in the section labeled "My Tools & Settings" click "Upload a document."

  • Once completed, save as a PDF. Do not print and scan this document.
  • From the Secure Document Uploader, select the document type "Marion JSC 2602 - Application"

2 - Waiver, Release & Consent

  • The Waiver, Release & Consent requires a signature. Print, sign, and scan this file as a PDF.
  • From the Secure Document Uploader, select the document type "Marion JSC 2602 - Waiver"

3 - Statement of Economic Interests

  • The Statement of Economic Interests may require additional pages. Combine the completed form and additional pages into a single PDF file.

4 - Current photograph

  • Make sure your photograph has a resolution of at least 300dpi and is saved in JPG format.

5 - Supplemental materials (outlined in the checklist above)

  • Combine additional materials to submit with your application into a single PDF file. If the file exceeds 15mb, try compressing it or splitting into multiple parts.

Letters of recommendation

The Marion County Judicial Selection Committee will consider on behalf of each applicant a reasonable number of letters of recommendation. Letters of recommendation must be sent by the deadline above to marionco.applicants@trialjudges.in.gov.

Judges and other judicial officers are permitted under the Code of Judicial Conduct to write on behalf of candidates on the basis of personal knowledge of the candidates' qualifications.

Letters sent to individual Committee members will be distributed to all other members.

Interviews

The Committee will conduct public interviews in Indianapolis in late September. Applicants are not prohibited from communicating with Committee members prior to public interviews. After the conclusion of interviews and an executive session to consider applicants, the Committee will publicly vote to select two panels of five nominees to send to Governor Mike Braun for appointment. Ind. Code § 33-33-49-13.4. Candidates must be available on the interview date, including evening hours.
