The Clerk is an Elected Constitutional official who performs as an officer of the court, the manager of court information, and the chief financial office for all revenues collected on behalf of the court.

In Indiana, the Clerk is also the official who oversees and conducts all elections as a member of the Election Board. The Clerks also serve on the County Commission on Public Records, and in some jurisdictions are the Jury Administrators.

Responsivities of the Clerk

The responsibilities of the Clerk are many and varied. In general, the Clerk is responsible for maintaining all of the records of the County courts that operate in their county. This includes:

• Filing the Record of judgments and orders which serves as the historical record of the court’s verbatim orders.
• Preparation of the Judgments and Orders which serves as the historical record of the court’s verbatim orders.
• Maintaining the Chronological Case Summary which is a sequential record of all of the judicial events in a case.

Additional Responsibilities

The Clerk also:

• Processes marriage applications and issues marriage licenses
• Collects and distributes all monies related to court cases
• Collects child support and assists in maintaining the records of the Indiana Child Support Enforcement Systems
• The Clerk maintains a variety of other records including:
  • Breathalyzer operator records
  • Conflict of interest statements of public officials
  • Oaths of office of all public officials
  • Records judgments against citizens of the county from other states and counties
  • State tax warrants

Indiana Clerks

In Indiana, the Clerk also administers all federal, state, county, municipal and special elections for that county.

• In counties without a separate board of Voter Registration, the clerk registers all voters within the county.
• The Clerk is a member of the Election Board which is responsible for preparing ballots, conducting the tests of the equipment, and training poll workers.
• On Election Day, the Clerk and their staff provides assistance to poll workers, media and the general public.
• The Clerk prepares the certification of the official vote totals.

Clerks of the Circuit Court

• The state of Indiana has 92 counties, and each county is served by the Clerk of the Circuit Court. While some jurisdictions have multiple courts, Spencer County has one circuit court.
• The clerk is an elected official who performs as an officer of the court, the manager of court information, and the chief financial officer for all revenues collected on behalf of the court.
• In Indiana, the Clerk is also the official who oversees and conducts all elections, as a member if the Election Board. The Clerk is responsible to administer and certify results for all federal, state, county, township, municipal, special, and school board elections.
• Clerks serve as members in the:
  • Association of Clerks of Circuit Courts of Indiana
  • Association of Indiana Counties (AIC)
  • National Association of Clerks, Recorders, Election Officials and Treasurers (IACREOT)
  • National Association of County Officials (NACO)
  • National Association of Court Management (NACM)
• Members of the Association of the Clerks of the Circuit Courts of Indiana are appointed to serve on the Indiana Voting Systems Advisory Committees, and the Commission on Courts; they also serve on the local Commission on Public Records.
