Individuals with disabilities continue to experience barriers that prevent them from receiving equal access to public buildings, programs and services, public transportation, and polling places. These barriers include physical inaccessibility to governmental and public places, reluctance on the part of service providers to provide reasonable accommodations, or outright denial of many types of services. Many times denial to provide access of reasonable accommodation is a result of ignorance of both characteristics of disabilities and the laws in place to ensure equal access.
The Americans with Disabilities Act (ADA) guarantees the rights of individuals with disabilities to have equal access to government buildings, programs, and services; transportation services; places of higher education; health care facilities; and restaurants, places of entertainment, and retail stores. The Fair Housing Act prohibits discrimination in housing opportunities on the basis of characteristics such as race or disability. The Commission has adopted the following objectives that IPAS staff will work to complete in order to increase access to individuals with disabilities:
Review allegations of discrimination on behalf of individuals with disabilities who have been denied services under Titles 2 and 3 of the Americans with Disabilities Act (ADA) or under the Fair Housing Act.
Assist individuals with disabilities in obtaining assistive technology services and devices in the areas of education, health care, employment, community living and in the use of telecommunications.
Assist or represent individuals with disabilities in the grievance procedure set forth in the Indiana Help America Vote Act Plan.
Provide advocacy services for individuals who allegedly have been subjected to disability-based discrimination when it is deemed that the case or situation may have systemic implications.
