Asset Management Program Reporting for Water and Wastewater Utilities

About the Study

This webpage is designed to assist water and wastewater utilities in complying with the asset management program reporting requirements under Ind. Code § 8-1-2-128, as established by House Enrolled Act 1459 (2025). The law requires water and wastewater utilities that are not under the Indiana Utility Regulatory Commission’s jurisdiction for rates and charges to submit a report to the Commission on the status of their asset management program every four years. This law applies to all types of utilities (with the exception of regional wastewater districts):

• Public utilities
• Municipally-owned utilities
• Not-for-profit utilities
• Cooperatively-owned corporations
• Conservancy districts
• Regional water districts

Reporting Requirements & Phased Compliance

The law requires compliance in stages on a four-year (quadrennial) basis. The first reporting cycle is from 2026-2029 and will focus on the status of each utility’s asset management program at the time of the report. Subsequent four-year cycles will look for improvements in plans, implementation over time, maintenance of the program, and management training.

The Commission is currently in the process of developing an online questionnaire that will serve as the report to be completed by each applicable water and wastewater by the due dates listed below. The online questionnaire should be made available in the first quarter of 2026.

Please note: The only deficiency in the first four-year cycle will be failure to submit a report – a utility asset management plan is NOT required to meet compliance.
