Business Counsel License

Overview

Admission and Discipline Rule 6 governs Admissions on Business Counsel License and Foreign License. The Indiana State Board of Law Examiners is charged with the responsibility of overseeing the admission of attorneys from other states seeking to be admitted in Indiana without taking the bar examination.

A committee of the Board of Law Examiners reviews Business Counsel License applications. A business counsel license is when a lawyer admitted in another state who establishes an office or other systematic and continuous presence in Indiana in order to accept or continue employment by an entity engaged in business in Indiana other than the practice of law, may be granted a license to practice law in Indiana, without examination upon a showing that he or she meets certain specified conditions. If approved, a personal interview before a member of that committee is required. If the committee is not unanimous in approval, a personal interview and approval before the full Board is required.


Education Requirements for Provisional License and Business Counsel License

Admission and Discipline Rule 6, Section 5 provides that in addition to any requirements found in Admission and Discipline Rule 29, within twelve (12) months of an applicant’s initial provisional license or business counsel license admission, the applicant shall attend an annual Indiana law update seminar, which seminar shall provide a minimum of twelve (12) hours of continuing education which has been approved the Indiana Commission for Continuing Legal Education.

Pursuant to Rule 6, Section 5, the Board of Law Examiners shall publish a list of approved seminars that meet the requirements of the rule.

The following seminars have been approved by the Board of Law Examiners as meeting the requirements of Rule 6, Section 5:

  • The annual Indiana Law Update seminar offered by the Indiana Continuing Legal Education Forum (ICLEF).
  • The annual Year in Review seminar offered by the Indiana Continuing Legal Education Forum (ICLEF).
  • The annual Indiana Law Survey seminar offered by Hoosier CLE and the Alumni Association of the Indiana University Robert H. McKinney School of Law.
