Small Utility Filing Procedure
The Small Utility Filing Procedure is designed to reduce the expense and time involved with regulatory filings, and can be used in rate cases before the Indiana Utility Regulatory Commission (IURC). The procedure is available to the following types of utilities, provided the utility serves fewer than 5,000 customers:
- A not-for-profit water utility
- A private rural water and sewer utility
- A private rural water utility
- An investor-owned water utility
- An investor-owned gas utility
- A municipal utility
- A distribution cooperative
The Small Utility Filing Procedure differs from traditional rate case filings because the utility's staff uses standardized forms. The utility is able to save money because of the simplified approach that the forms allow. Decisions to rely on this procedure should be based on the case's complexity, the existence (or absence) of unusual issues, and the knowledge of utility personnel completing the forms. The Small Utility Filing Procedure may allow these cases to proceed within a shorter time frame than traditional rate cases. In addition, formal hearings requiring the presence of attorneys and expert witnesses may not be required.
Small utility filings face the same standards of OUCC and IURC review as traditional utility filings. The OUCC conducts its review on behalf of consumers, while the IURC's review is conducted on behalf of the public interest (a balancing of utility and customer interests).
