10:15 a.m.     David Dragon v. State of Indiana

The Boone Superior Court denied a motion to correct erroneous sentence. The Court of Appeals reversed. Dragon v. State, 774 N.E.2d 103 (Ind. Ct. App. 2002). The Supreme Court granted a petition to transfer filed by the State of Indiana, thus vacating the opinion of the Court of Appeals, and has assumed jurisdiction over the appeal.

9:00 a.m.     Robert J. Bassett, Jr. v. State of Indiana

Robert Bassett was convicted on four counts of murder in Bartholomew Superior Court. He was sentenced to four terms of life imprisonment. He appeals, raising various challenges to the admission of evidence.

9:45 a.m.     Tiverio Serrano Luna v. State of Indiana

Tiverio Luna was convicted on two counts of child molesting in Tippecanoe Superior Court. The Court of Appeals reversed and remanded for a new trial. The Supreme Court granted a petition to transfer filed by the State of Indiana, thus vacating the unpublished memorandum decision of the Court of Appeals, and has assumed jurisdiction over the appeal.

9:00 a.m.     City of Gary v. Smith & Wesson Corp.

The City of Gary sued handgun manufacturers, distributors, and dealers, alleging public nuisance and negligence. The Lake Superior Court granted the defendants’ motions to dismiss for failure to state a claim. The Court of Appeals affirmed the dismissal of all claims except the public nuisance claims against dealers alleged to have participated in illegal “straw purchases.” See City of Gary v. Smith & Wesson Corp., 776 N.E.2d 368 (Ind. Ct. App. 2002). The Supreme Court has granted transfer, vacating the opinion of Court of Appeals, and has assumed jurisdiction over this appeal.
