COMPLIANCE with Electronic Prescribing of Controlled Substances (EPCS) regulations

Effective December 31, 2021, in compliance with Senate Enrolled Act 176, the State of Indiana mandates that ALL prescriptions for a controlled substance be issued through an electronic format and transmission (E-prescribing).

In compliance with Senate Act 176 and the Patients and Communities Act passed by the federal government in 2018, the State of Indiana through INSPECT is now providing funding to ensure that all practices are in full compliance by the state's statutory deadline of December 31, 2021. Dentists, Physicians, Advanced Practice Registered Nurses, Optometrists, Physician Assistants, and Podiatrists in violation of these provisions will be subject to disciplinary action.

Eligibility Requirements

FUNDING availability for the EMR E-Prescription Implementation

INSPECT will determine your eligibility for funding benefit of the Electronic Medical Record (EMR) system implementation with E-Prescription capability. You must meet one of the following three eligibility requirements to possibly qualify for funding:

  • You do NOT have an existing EMR system
  • You do NOT have an existing E-Prescribing functionality
  • You do NOT have an EMR system with E-prescribing functionality

The Federal Government Act also includes legislation that requires ALL Medicare Part D practitioners to begin electronically prescribing Part D drugs requiring prior authorization on January 1, 2022.
