Certificate of Need Program

The new Certificate of Need program became effective on July 1, 2019 for Indiana comprehensive care facilities (nursing homes).  The Certificate of Need program is the result of Senate Enrolled Act 190 from the 2018 session of the Indiana General Assembly.

Review Process and Timeline for Certificate of Need

The review process will occur every year and begin on July 1 and last until the following June 30.  The law sets out the review period as follows:

July 1 ISDH will publish the results of the county by county need formula before July 1.
July 31 Certificate of Need applications will be accepted through July 31.
August 15 ISDH will publish submitted Certificate of Need applications by August 15.
October 15 ISDH will accept public comments on submitted Certificate of Need applications through October 15.
April 30 Any decision on an accepted Certificate of Need will be made no later than April 30.

Certificate of Need applications must be received by July 31 and be accompanied by all information required in the application, including a non-refundable $5,000 application fee.
