Abortion Clinic Licensing Program
A freestanding entity that performs abortion procedures must be licensed as an abortion clinic. Such an entity does not include a hospital that is licensed as a hospital, an ambulatory surgery center that is licensed as an ambulatory surgery center, or a physician’s office as long as the surgical procedures performed at the physician’s office are not primarily surgical abortion procedures and abortion inducing drugs are not the primarily dispensed or prescribed drug at the physician’s offices.
The ISDH monitors the health care quality of abortion clinics through the state licensure process. Abortion clinics are licensed for one year. ISDH surveyors visit abortion clinics at least once every two years and conduct an inspection of the facility for compliance with state rules.
As a result of a recent U.S. Supreme Court decision, an injunction preventing the enforcement of certain provisions of HEA 1337 from 2016 was lifted September 3, 2019 and these provisions are now enforceable. This law updated the requirements for the disposition of miscarried remains/aborted remains (“fetal remains”) in Indiana.

Individuals can call or email to make complaints about care provided at any licensed or certified Indiana health care provider or supplier.
Abortion Informed Consent Brochure
The ISDH was required by Indiana statute to develop an informed consent brochure and post on the department’s web site [Senate Enrolled Act 371 (2013) - IC 16-34-2-1.5]. The abortion provider is required to provide the pregnant woman with a color copy of the brochure [IC 16-34-2-1.1(a)(4)]. The ISDH Abortion Informed Consent Brochure is the statutorily required brochure.
The printer/copier version may be used to print the brochure from a desktop printer or standard copier. The pages will print individually in numerical order.
Clinics or organizations may want to have a larger volume of brochures printed by a printing company. This version is intended for use by a printing company. The version is designed to print on larger pages and then folded over and bound in the middle to form a brochure. This version allows the provider to fill in the information on the back cover prior to printing. The form may be saved as an Acrobat file.

The ISDH Perinatal Hospice and Palliative Care Information Center is intended to provide information about perinatal hospice and palliative care. Hospice and palliative care services provide medical, nursing, spiritual, emotional, social, and bereavement care to families experiencing consequences of a perinatal loss.
