Laws and Rules

The IDEM Office of Land Quality (OLQ) administers several waste programs, which are governed by the following laws and rules. State laws come from the Indiana Code (IC) and state rules come from the Indiana Administrative Code (IAC). Federal Regulations come from the Code of Federal Regulations (CFR).

Indiana statutes give authority to IDEM to oversee the management of solid waste. Solid waste disposal, storage and processing and other management activities such as, landfills, transfer stations, waste tire operations, collection container systems are regulated by the solid waste rules in 329 IAC. The U.S. Environmental Protection Agency (U.S. EPA) has approved IDEM’s solid waste program for municipal solid waste landfills as meeting the national Resource Conservation and Recovery Act (RCRA) 40 CFR 258 Subtitle D requirements.


Indiana's environmental laws are codified in Indiana Code (IC) 13 Environmental Statutes.


Rules for programs implemented by OLQ are covered in Indiana Administrative Code (IAC) 327 and 329.

Old solid waste rules, now repealed, were covered under SPC 18, 329 IAC 1.5, and 329 IAC 2. These rules apply to some old facilities operated and closed when these rules were in effect.
