This page is dedicated to rules and guidance related to federal and state Stage II Vapor Recovery requirements. Vapor Recovery requirements exist to ensure the implementation of technologies that would trap vapors that have been found to contribute to the formation of harmful ozone in our atmosphere. Stage II Vapor Recovery requirements have been waived by the United States Environmental Protection Agency (U.S. EPA) because onboard refueling vapor recovery (ORVR) technology is in widespread use throughout the motor vehicle fleet for purposes of controlling motor vehicle refueling emissions. This waiver is applicable once key anti-backsliding provisions associated with the applicable State Implementation Plan have been addressed. ORVR technology has made the requirements for gasoline dispensing facilities in nonattainment areas classified as “Serious” and “Above” for the ozone National Ambient Air Quality Standards (NAAQS), and stipulated in the federal and state Stage II Vapor Recovery requirements, less effective in reducing ozone precursor emissions.
