We can 17 1 move to number -- or the next item on the agenda 2 is Final Orders, and in the cases of Jeffrey 3 Coleman versus Bella Vita, LLC doing business as 4 Bella Vita Ristorante, we need approval for the 5 final orders for Jeffrey Coleman versus Bella 6 Vita and Rodney Harris versus Bella Vita. 7 MS. POSEY: Oh, if I may? 8 CHAIRMAN RAMOS: Sure. 9 MS. POSEY: So, I was the 10 Administrative Law Judge when these cases came 11 about, so I just wanted to give you just a brief 12 overview of the cases. They -- both of these 13 cases were settled by the parties, and there was 14 a joint motion to dismiss the case. As ALJ, I 15 signed the proposed order to dismiss the case 16 based on the joint motion, so we just need your 17 final approval of that. 18 CHAIRMAN RAMOS: Okay. 19 Is there any discussion or questions? 20 (No response.) 21 CHAIRMAN RAMOS: Hearing none, I need 22 approval to approve the final orders for 23 dismissal. 18 1 COMM. POSEY: And briefly I'll speak on 15 this one as well. So, Richard Hite, in his 16 official capacity as Executive Director of the 17 Indiana Civil Rights Commission versus Zender 18 Family Limited Partnership, this was a housing 19 case on the basis of disability. 20 I had a hearing in this case. I presided 21 over a hearing in this case a few months ago. I 22 issued a proposed decision in this case, which 23 you all have that, and Respondent objected to my 19 1 proposed decision. 2 (Discussion off the record.) 3 MS. POSEY: Okay. And so, you will 4 have the proposed decision, and you'll also have 5 the objections to review for the next meeting to 6 issue your decision on. 7 Thank you. 8 CHAIRMAN RAMOS: So, do we need -- 9 that's really just an update. You guys will already have the document 22 that you need to review, so you can have -- ask 23 your questions, get any clarification, before you 20 1 make your decision. 2 CHAIRMAN RAMOS: Okay. So, just for 3 clarification on this one, because it cites the 4 Indiana Civil Rights Commission as -- and the 5 Zender Family, so someone's going to represent 6 the ICRC? 7 MS. POSEY: Correct. So, this case, 8 our housing cases are all brought under the 9 Director, so our staff attorneys represent the 10 Indiana Civil Rights Commission in the public's 11 interest, so they will be speaking on behalf of 12 the Indiana Civil Rights Commission, in our 13 capacity as furthering or upholding the public's 14 interest, and the Respondent, their attorney will 15 be here to talk about their objections -- 16 CHAIRMAN RAMOS: Okay. 17 MS. POSEY: -- to the proposal of the 18 Administrative Law Judge. 19 CHAIRMAN RAMOS: Thank you. I 20 appreciate that clarity. 21 MS. POSEY: Uh-huh. 22 COMM. LONG: And all of the 23 informations are in this new folder; right? 21 1 JUDGE BURKHARDT: That is correct. 2 COMM. LONG: Okay. 3 JUDGE BURKHARDT: And if the parties 4 want to submit any briefs beforehand, they would 5 be -- 6 COMM. LONG: Thank you. 7 JUDGE BURKHARDT: -- routed to all 8 Commissioners. 9 CHAIRMAN RAMOS: We would like to get 10 that at least a week ahead of time so we can 11 review those documents, please. 12 MS. POSEY: They only get 15 days 13 from now to -- if they have anything to submit, 14 so you will receive them as soon as we receive 15 that. 16 CHAIRMAN RAMOS: Okay. Executive 17 Director's Welcome and Report. 18 MS. POSEY: Well, as Deputy Director, 19 I will just mention briefly -- give you a brief 20 overview of our cases from the previous month and 21 where we are looking as an agency, so in the 22 month of August, we had 216 inquiries to file 23 complaints, so 216 people either called us, filed 22 1 a Web inquiry, or walked into our office to file 2 a complaint of discrimination in the month of 3 August. Out of those 216, 106 of them were 4 employment cases, 39 were housing, and 37 were 5 public accommodation cases. 6 And I also looked regionally where our 7 cases are coming from. Out of those 216 -- and 8 I'm sorry for saying "cases." I mean inquiries. 9 Out of those 216, 103 of them came from Region 5, 10 which is Central Indiana, Region 1 and Region 6 11 were both in second place at 20 inquiries each, 12 so we'd like to keep track of that to see where 13 people are calling from, to see if there are any 14 trends that we'd like to look deeper into. And 15 then also, if we're not getting any complaints 16 from particular regions, what kind of outreach 17 we're doing in those regions. 18 And as far as closures for the month of 19 August, we've closed 131 cases as no probable 20 cause, so that includes any objections that were 21 filed prior to August 31st and that you as 22 Commissioners ruled the final orders on, and then 23 those who did not file any objections or any 23 1 appeals. 2 If you have any questions for me, I'd be 3 happy to answer anything. 4 CHAIRMAN RAMOS: Are there any 5 questions? 6 COMM. EDWARDS: No. 7 COMM. SLASH: No. 8 CHAIRMAN RAMOS: A couple of 9 comments. So, I would like to see the financials 10 on a monthly basis -- 11 MS. POSEY: Okay. 12 CHAIRMAN RAMOS: -- so that they can, 13 A, be in our document review, and B, give Pam the 14 opportunity to provide some update on where we're 15 at from the Commission's standpoint. We have a 16 broad expanse now with all of the different, you 17 know, organizations that we support, from the 18 Hispanic to Martin Luther King, so it's just good 19 to get an update of where we're at, and we do 20 have responsibility for it. 21 Number two, it would be good to see the 22 caseload as well in our reports -- 23 MS. POSEY: Okay. 24 1 CHAIRMAN RAMOS: -- that's held 2 before us, to see -- I always like to see a trend 3 just so we can look back, and we're always seeing 4 a big peak, with the whole DACA initiative that's 5 going on, a lot of challenges that are in the 6 administration, are we seeing situations, are we 7 hearing cases? And again, our standpoint is are 8 there areas that we can provide assistance? Is 9 there something that we can do sitting in this 10 capacity -- 11 MS. POSEY: Uh-huh. 12 CHAIRMAN RAMOS: -- that can help? 13 MS. POSEY: Okay. So, what I'm 14 hearing is that you want the full agency report 15 that we do monthly to be added to what you 16 receive every month, so that will include all of 17 the enforcement items that I've kind of talked 18 about, our financial piece, and also our outreach 19 and external affairs as well. 20 CHAIRMAN RAMOS: Yeah. 21 MS. POSEY: Okay. And I did want to 22 mention that we just hired a staff attorney last 23 week, so Caroline Ryker will be our third staff 25 1 attorney. She just graduated from law school, 2 and we just found out earlier this week that she 3 passed the Bar, so she will be our new staff 4 attorney once she's sworn in next month. 5 We have also hired a new ADR/Compliance 6 Officer. This person will be the Program 7 Director over our Mediation and ADR Unit, and she 8 will also make sure that the parties are in 9 compliance with what the final orders say. So, 10 if in the final order the parties were charged to 11 have diversity training done or have notices up 12 in their place of business, that Compliance 13 Officer will make sure that those things are done 14 in the time that they're supposed to have it 15 done, and if not, we will help to enforce that. 16 So, those two positions have been 17 fulfilled this month, and we also made offers to 18 two people in our Intake Department, so once 19 those people are in -- once they've accepted the 20 position and gone through the process, by 21 probably the beginning of next month they will 22 also be here and we'll have a full Intake staff, 23 which is something we're very excited about. 26 1 That's it. Any other questions for me? 2 CHAIRMAN RAMOS: A couple of 3 comments. 4 MS. POSEY: Yes. 5 CHAIRMAN RAMOS: So, really, they're 6 more directed at the Executive Director, and I 7 know he's just getting his arms around all of 8 this, and I -- having taken on new capacities, I 9 fully appreciate where he's coming from, but at 10 some point we'd like to -- we need to see a time 11 line on what his strategy is. 12 MS. POSEY: Uh-huh. 13 CHAIRMAN RAMOS: So, to kind of go 14 through his vision of where the Commission is 15 going and where he wants to see that accomplished 16 over the next three, four years, anyway, and I 17 think that's helpful for all of us, so if we can 18 get help to get on that bandwagon and provide 19 input to it as well. 20 So, we'd like to have that opportunity. 21 Not expecting a full report at the next meeting, 22 but some kind of time line, we think that would 23 be viable, if that would be okay. 27 1 MS. POSEY: Yes. 2 CHAIRMAN RAMOS: And I don't see an 3 event calendar, so what events do you have coming 4 up next? 5 MS. POSEY: We'll make sure -- that's 6 going to be on the agency report as well -- 7 CHAIRMAN RAMOS: Okay. 8 MS. POSEY: -- for the future. 9 CHAIRMAN RAMOS: Thank you. 10 MS. GORDON: Yeah, thank you for 11 asking. That gives me an opportunity to get up. 12 I'm Lesley Gordon. I'm the Manager of External 13 Affairs. We are continually adding to that event 14 calendar. We just recently had myself, our 15 Deputy Director and General Counsel and a staff 16 attorney attend the John Marshall Law School Fair 17 Housing Conference in Chicago, it was a two-day 18 conference, really great, a lot of best practices 19 and great speakers. 20 We just attended the Indiana Latino 21 Institute's Heritage Annual Luncheon. Next week 22 we will be participating and sponsors of the 23 Circle City Classic Parade. We'll have an active 28 1 role in their coaches luncheon as well as during 2 the game, so excited to participate in that 3 event. And also, I wanted to comment, if 10 you or the Commission is interested in reaching 11 out to other ethnic groups, and I heard that you 12 attended the event at the Latino Affairs. That's 13 great. So, if there are other ethnic groups that 14 you would want to reach out to, I'd be very happy 15 to assist you. 16 MS. GORDON: Yes, I will definitely 17 utilize that, and we are doing a targeted 18 research in outreach to make sure that we are 19 identifying those different populations within 20 the state and then making sure we are hitting 21 their events moving forward, and that'll be 22 reflected in the event calendar. That will be 23 next week. 29 1 So, I am a new member of the Migrant Farm 2 Workers Coalition, which works with those migrant 3 farm worker populations, and there's a resource 4 group that -- so that we can offer services to 5 those people in that Coalition, and we meet on a 6 monthly basis. So, I'll be meeting with them. 7 The first meeting was last month, and then this 8 next one will be next week. 9 CHAIRMAN RAMOS: Very good. Thank 10 you.
