The Office of General Counsel strives to provide clear informative legal guidance to FSSA as each division develops and administers its important programs to Hoosiers in need. We achieve this goal by engaging in proactive and open communication with FSSA staff regarding legal issues as they arise. Additionally, our attorneys are continuously strengthening their legal knowledge and expertise to ensure FSSA adheres to state and federal laws, regulations and policies.

Access to Public Records Act
A public record is any record that is created, received, retained, maintained, or filed by or with a public agency. Public records may be generated on paper, paper substitutes, photographic media, chemically based media, magnetic or machine-readable media, electronically stored data, or any other material.
If you receive a request for public records, regardless if it is verbal or written, please go to the APRA Portal. For in-person and telephonic public records requests, be sure to capture and forward the name, address, phone and email for the requestor with a public records request.

Ethics Information
The FSSA Ethics Officer is available to advise employees and special state appointees regarding ethics questions and concerns. Please direct your ethics inquiries to the Ethics Officer at fssa.ethics@fssa.in.gov.

Rule Promulgation
The Office of General Counsel assists the divisions with rule promulgation for the Indiana Administrative Code. The IAC is a set of regulations adopted by various state agencies. FSSA regulations can be found in Title 405 (OMPP), 440 (DMHA), 455 (Aging), 460 (DDRS), and 470 (DFR and OECOSL).
The rule promulgation process is a lengthy and complex process, governed by Indiana Code 4-22 and executive orders. Rule promulgation typically takes eight-12 months, and requires the approval of multiple state agencies and the governor’s office.
