Clerk Darrell Stephens reminds couples there are a few rules and tips to expedite getting a marriage license. It is recommended applicants use this information or go to the Indiana Courts website to begin the process before coming to the Clerk's office. Please call Clerk Stephens in advance to schedule an appointment to complete the marriage license process. It is preferred the appointment start before 3:30 p.m. Both applicants must be present.
When to Apply
- Monday through Friday
- 8 a.m. to 4 p.m.
- Appointments for the marriage application are suggested.
Where to Apply for Your Marriage License
- Indiana residents must obtain a Marriage License in the county in which at least one of the applicants resides.
- Out of state residents must obtain a Marriage license in the county in which the marriage will be preformed.
- Both applicants must apply for the marriage license in person at the same time.
Online Application
If you meet all the requirements to obtain a marriage license you may begin your application online. You will still need to go to the Clerks office but this will save you time.
Previous Marriage
If either applicant has been married previously, the license application requires information on the month, date, year and manor (e.g, divorce, death, annulment) in which the marriage ended. You must show proof with your most recent divorce decree, or a death certificate.
Identification (ID)
Applicants must be over the age of 18 to apply for a marriage license. You must show ID to apply for a marriage license.
The following forms of ID are accepted at the time of the application:
- Current State ID Card
- Military ID Card
- Original certified birth certificate (With a picture ID card)
- Passport
- Valid Drivers License
No Legal Waiting Period
In Indiana there is no legal waiting period. A couple may get married the same day as the application. Once issued, the marriage license is valid for 60 days during which time the
marriage must be performed.
Age Requirements
Applicants must be over the age of 18. Under the age of 18 please contact the Clerk’s office for additional information and or instructions at (812) 649-6028.
Cost for the Marriage License
The cost for the application is $25.00 cash for Spencer County residents and $65.00 cash for out of state residents that are getting married in Spencer County. This does not include the cost for a certified copy of the marriage license.
Certified Copies
For a certified copy of the marriage license please send a request and $4.00 for each copy requested along with a self addressed stamped envelope to:

Please include the couple’s names and the date of the marriage in the written request.
Change of Name
Many brides decide to change their names after getting married. When you apply for your marriage license you will receive a form from the Clerk’s office that has information from the Social Security Office about changing your name on your Social Security card.
To find the Social Security office nearest to you call 800-772-1213 or visit the Social Security website. You will need to contact the License Branch about changing your driver’s license or your personal ID card. You can get additional information at the Bureau of Motor Vehicles.
