Expungements

Everyone deserves a second chance, now you may be able to expunge your criminal history.

What is Expungement?

Expungement is a court-ordered process in which the legal record of an arrest or a criminal conviction is "sealed," or erased in the eyes of the law. Your arrest record is removed from the official records of the arresting authority and the Department of State Police. Your name is removed from the official index that the Circuit Clerk must keep. Employers and law enforcement officials cannot see the record.

Procedure

The procedure to seal or expunge records under I.C. 35-38-9 is extremely complex, has not yet been fully litigated and contains severe consequences if mistakes are made. The Indiana Supreme Court Division of State Court Administration and the Indiana Judicial Center strongly recommend that you seek legal advice from an attorney before filing a petition on your own especially if you are seeking to seal or expunge more than one record.
