Taylor announces 2010 legislative agenda

INDIANAPOLIS-Lawmakers are gearing up for a short, but challenging 2010 legislative session with many important issues at the forefront. State Senator Greg Taylor (D-Indianapolis) has authored several bills.

Family law and custody rights
Under Senate Bill (SB) 153, the determining factors for a judge in awarding joint legal custody of a child would be amended to include whether the child has had an opportunity to establish a relationship with the mother and/or father. Furthermore, both the mother's and father's wishes to establish a relationship with the child would be considered, as well as whether either parent has attempted to prevent the other parent from establishing a close beneficial relationship with the child.
                                                     
SB 154 would give the mother primary physical custody of the child upon the execution of a paternity affidavit. The father would have parenting time in accordance with the parenting time guidelines unless another determination is made by the court. Under current law, the mother has sole custody of the child unless another determination is made by the court.

Recovery of stolen items
SB 155 would require a pawnbroker to return a stolen item immediately to an individual who alleges that the item was stolen from the individual, if the individual: (1) presents the pawnbroker with a police report demonstrating that the item has been stolen; (2) presents the pawnbroker with a receipt that specifically identifies the stolen item by serial number; and (3) agrees to participate in the prosecution of and appear as a witness against the person who pledged or sold the stolen item. The bill also provides that a pawnbroker who returns a stolen item to its owner has a cause of action against the person who sold or pledged the item to the pawnbroker.

State Contracts
SB 228 would expand current law concerning state contract participation by minority and women's business enterprises to include health care services.  Currently, statute provides that goods and services do not include health care services when determining the value of contracts for state projects.
