Indiana State Police arrested a Portland, Indiana bail bondsman at 9:30 a.m. this morning on theft and obstruction of justice charges.
On October 27, 2009 the Jay County Prosecutor's Office contacted Detective Andy Byers (Redkey District) to conduct an investigation involving allegations that John P. Osburn, age 41, 10013 W. 150 South Dunkirk, Indiana removed a bond he issued from court documents. Osburn is the owner of D and J Bonds in Portland, Indiana.
On September 16, 2009, Osburn issued a bond for $7,000.00 to a defendant cited into Jay County Superior Court. Osburn received from a person posting the bond, a personal check in the amount of $700.00, or 10% of the bond. On September 17, 2009, the check was returned to Osburn for insufficient funds.
In lieu of petitioning the court to revoke the bond, Osburn allegedly removed the bond documents from the Jay County Superior Court files on September 17, 2009.
Byers completed his investigation and turn his findings over to the Jay County Prosecutor for their review. An arrest warrant was issued from Jay County Circuit Court yesterday, preliminarily charging Osburn with: Theft and obstruction of justice, both class "D" felonies.
Sergeant Rob Ricks and Byers arrested Osburn without incident at his business and taken to the Jay County Jail. He is being held on $5,000.00 bond. Additional charges are pending.
