UPDATE: An IURC final order approving the settlement agreement in this case was issued on Oct. 11, 2006.
OUCC News Release, Issued Oct. 3, 2006:
A pending agreement between the Indiana Office of Utility Consumer Counselor (OUCC) and Aqua Indiana, Inc. would mean new ownership for the Darlington Water Works Company in Montgomery County.
Aqua Indiana - a subsidiary of Aqua America, Inc. - is seeking Indiana Utility Regulatory Commission (IURC) approval to purchase Darlington's water utility from the City of Indianapolis for $255,000. The agreement between the company and the OUCC will allow the sale to go forward if the IURC approves.
The OUCC - the state agency representing consumer interests in cases before the IURC - agrees that the proposed purchase is in the best interest of Darlington's 315 customers. According to the pending agreement, Aqua Indiana is willing to make significant capital improvements and will continue to charge the utility's existing rates after the sale is approved.
The Indianapolis Water Company (IWC) - which was a subsidiary of Merrillville-based NiSource, Inc. at the time - purchased the Darlington water utility's assets in 1999. The City of Indianapolis purchased IWC's assets in 2002 and accepted Aqua Indiana's purchase bid earlier this year.
The Indiana Office of Utility Consumer Counselor (OUCC) is the state agency that represents residential and business consumer interests in cases before state and federal utility regulatory commissions. To learn more, visit www.IN.gov/OUCC.
