FAQs and Information about Electronic Prescribing
- What is an electronic prescription?
- The only difference between a regular prescription and an electronic prescription is that an electronic prescription: (1.) contains the electronic signature of the practitioner and (2.) is transmitted in accordance with relevant state law.
- What is an electronic signature?
- An electronic sound, symbol, or process attached to or logically associated with an electronically transmitted prescription that is adopted by a person, who intends to sign the electronic prescription.
- A prescription may be electronically transmitted from a practitioner using a computer or other device, to a computer or electronic device in a pharmacy, only through the use of an electronic data intermediary approved by the Board.
- Electronic Data Intermediaries must complete an application and provide additional information as required by the Board.
- Practitioners and Pharmacies that have software that is meant for the transmission and receipt of electronic prescriptions, should share the law with their software vendors to ensure that they are in compliance with state law.
- Can controlled substances be electronically transmitted?
- Only to the extent allowed under Federal Law, which presently, does not allow for an electronic prescription as described in this law.
- If a controlled substance is transmitted electronically, a verbal authorization from the practitioner must be received.
- Is a fax that is sent through a computer or other electronic device an electronic prescription?
- No
- A faxed prescription has requirements set out in 856 IAC 1-31-1
- A faxed prescription must also meet the requirements of IC 16-42-22.
