The rate increase authorized in Cause No. 43526 has never been applied to customer bills.

 

UPDATE (1/15/11): On September 24, 2010, the Indiana Office of Utility Consumer Counselor (OUCC) filed two notices with the Indiana Utility Regulatory Commission (IURC) regarding the IURC's August 25, 2010 order in the Northern Indiana Public Service Company (NIPSCO) electric rate case.

The OUCC's first filing is a Notice of Contest to the schedule of rates and charges NIPSCO filed with the IURC on September 14, 2010. The IURC's August 25 order required NIPSCO to file new schedules of rates and charges, proofs of revenues, and a cost of service study within 30 days. The order then gave the OUCC and other formal parties to the case up to 10 business days to challenge NIPSCO's compliance filing.

With the Notice of Contest filed, the terms of the Commission order required that a procedural schedule be established for the IURC to consider arguments from the case's formal parties regarding NIPSCO's compliance filing. While filings and IURC technical conferences are scheduled through late February 2011, a pending motion requests that the IURC vacate the rest of the schedule.

The OUCC's second filing is a Notice of Appeal, which preserves the agency’s legal rights to challenge the IURC’s order before the Indiana Court of Appeals. In a November 8 order, the Court of Appeals granted a motion to stay the appeal and is holding the case in abeyance while the proceedings before the IURC continue.

The Indiana Utility Regulatory Commission (IURC) issued a final order in Cause No. 43526, the Northern Indiana Public Service Company (NIPSCO) electric rate case, on August 25, 2010. For a copy of the 131-page order in PDF format, please click here.

The Indiana Office of Utility Consumer Counselor (OUCC) filed testimony on May 8, 2009 recommending denial of the utility’s requested increase. 

IURC public field hearings and OUCC informational meetings in this case were held in March 2009 in Gary and in July 2009 in Michigan City.
