ORDER

 

It is ordered that the previous determination that a water well driller's license not be issued to Mrs. Mary L. Barnes d/b/a Atlas Pump Company remains undisturbed.

 

FINDINGS OF FACT 

 

1.  IC 25-30-1-2 provides:  "From and after July 1, 1959, a licensed water well drilling contractor shall be required to keep accurate records for each water well drilled and for each test well drilled in connection therewith.  The record for each water well shall contain the following information; 

 

1)  The location of the well; 

2)  The depth and diameter of the well;

3)  The date the contractor completed the well; 

4) The character and thickness of materials or formations drilled; and

5) The state water level and performance data of the well. 

A water well drilling contractor shall, within thirty (30) days after the completion of a well, forward a copy of the record of the well to the office of the Division of Water Resources of the Indiana Department of Conservation (Department of Natural Resources) on forms prescribed and provided by the Department, or on approved contractor's forms.  Upon written application made by the owner or driller of a water well, the Department of Conservation (Department of Natural Resources) shall keep the record of any water well confidential for a period  of six (6) months and such record shall not be considered to be a public record.  The Conservation Department (Department of Natural Resources) may extend the six (6) month period for good and sufficient cause presented by the applicant, (Acts 1959, ch. 6, section 2, p. 19.)" 

 

2.  Between July 1976 and July 1977, Mary L. Barnes d/b/a Atlas Pump Company, was a licensed water well driller.

 

3.  That during the said period Atlas Pump Company was licensed to operate three drilling rigs. 

 

4.  That during the period January 1 to July 30, 1977 Atlas Pump Company drilled at least thirty water wells and filed only one drilling report. 

 

5.  That during the late summer or early fall of 1976, Atlas Pump Company drilled a water well at 2432  Silver Lane Drive, Indianapolis, Indiana. 

 

6.  That during all periods above-mentioned, Atlas Pump Company did not file complete records of wells drilled as required by IC 25-39-1-2, despite several reminders by Water Division staff that these reports were due.
