The Commission adopted Information Bulletin #56 (LSA #08-13), a nonrule policy document that describes legal principles to identify riparian zones within “public freshwater lakes” under IC 14-26-2 and within “navigable” waters under IC 14-29-1.
During its July 2008 meeting, the Commission gave preliminary adoption to rule amendments to implement P.L. 84-2008 governing consolidated proceedings between its Division of Hearings and the Office of Environmental Adjudication. The legislation and rule amendments would allow a party to seek consolidation of separate adjudicatory proceedings pending between the two agencies if the proceedings involve common issues directed to water quality or water quantity. On September 10, 2008, the Legislative Services Agency published Notices of Intent to pursue implementation language for the Commission (LSA Document #08-688) and parallel implementation language for OEA (LSA Document #08-689). For the convenience of parties and their attorneys, the Division of Hearings maintains a version of its procedural rules (312 IAC 3-1) with unofficial annotations. The rules with annotations were recently updated and are accessible at here.
