Establishment
Sec. 1. A state student assistance commission is established. The
commission:
(1) is a separate body corporate and politic;
(2) is not a state agency; and
(3) performs essential governmental functions.

Membership
Sec. 2. The members of the commission must be citizens of
Indiana and appointed by the governor.

Membership; representation of district
Sec. 3. Each congressional district must be represented by one (1)
member who is a resident of the district.

Appointment of student member
Sec. 4. The governor shall appoint an at-large student member of
the commission who is a student at an approved postsecondary
educational institution. The governor shall select the student member
from a list of at least three (3) and not more than five (5) names
submitted by a nominating committee consisting of students of
approved postsecondary educational institutions.

Appointment of student nominating committee
Sec. 5. The chairperson of the commission shall appoint the
members of the student nominating committee.

Membership; restrictions
Sec. 6. A member, while serving a term, may not be:
(1) an employee of or serve on the governing board of any:
(A) state educational institution; or
(B) private college, university, postsecondary proprietary
educational institution, school corporation, or other
educational institution in Indiana; or
(2) in any other capacity as an employee or official of the state
of Indiana.

Meetings
Sec. 7. At the first meeting of the commission held after August
1 of each year, the members of the commission shall select a
chairperson, vice chairperson, and secretary from among their
number.

Compensation of members
Sec. 8. A member of the commission is not entitled to
compensation, but is entitled to a per diem for attending meetings of
the commission and for expenses necessarily incurred in performing
the member's duties.

Terms
Sec. 9. The term of office of each member, except the student
member, is three (3) years, beginning August 1 of the year of
appointment and continuing until the member's successor is
appointed and qualified. The term of office of the student member is
two (2) years, beginning August 1 of the year of appointment and
continuing until the member is no longer a student at an approved
post secondary educational institution or until the member's
successor is appointed and qualified. Vacancies shall be filled by the
governor.
