TITLE 312 NATURAL RESOURCES COMMISSION

Emergency Rule

Temporarily amends 312 IAC 9-3-3 to add rifle and handgun calibers that are legal for taking deer as authorized by IC 14-22-2-6. Effective September 15, 2016.


SECTION 1. (a) This SECTION is supplemental to 312 IAC 9-3-3(d)(2).

(b) An individual may take a deer with a handgun that fires the 10 mm Automatic or 40 Smith and Wesson cartridge.

(c) A handgun authorized under this SECTION must:
(1) conform to the requirements of IC 35-47-1-6;
(2) have a barrel length of at least four (4) inches long; and
(3) not be a rifle with a barrel less than eighteen (18) inches long.

(d) While hunting deer an individual is prohibited from firing full metal jacketed bullets with a handgun authorized under this SECTION.

SECTION 2. (a) This SECTION is supplemental to 312 IAC 9-3-3(d)(4).

(b) An individual may take a deer with a rifle authorized under the authority of this SECTION that has a cartridge that fires a bullet having a diameter of:
(1) .243 inch or 6 millimeter; or
(2) .308 inch or 7.62 millimeter.

(c) A rifle authorized under this SECTION must:
(1) have a barrel length of at least sixteen (16) inches;
(2) be used to take deer only on private land; and
(3) fire a cartridge having a minimum case length of one and sixteen-hundredths (1.16) inches.

(d) While hunting deer an individual is prohibited from:
(1) firing full metal jacketed bullets with a rifle authorized under this SECTION; or
(2) possessing more than ten (10) cartridges for each rifle possessed under the authority of this SECTION.

SECTION 3. This document is effective on September 15, 2016.

SECTION 4. This document expires on January 31, 2017.
