TITLE 345 INDIANA STATE BOARD OF ANIMAL HEALTH

Notice of Intent to Adopt a Rule

Under IC 4-22-2-23, the Indiana State Board of Animal Health intends to adopt a rule concerning the following:

OVERVIEW: Amends 345 IAC 1-6 governing reportable diseases. The proposed rule amends Indiana's reportable disease rule by adding and deleting diseases required to be reported to the Board of Animal Health, including aligning the state list with the National Animal Health Reporting System (NAHRS) and the World Organization for Animal Health (OIE) list. Adds 345 IAC 3-5.5 to require a herd owner, veterinarian, or laboratory personnel to report a presumptive positive case or confirmed positive case of porcine epidemic diarrhea virus (PEDv), porcine delta coronovirus (PDCoV) or other emerging swine enteric coronavirus disease (SECD) to the state veterinarian within two business days. The proposed rule will require a herd owner whose herd meets the case definition for SECD to develop, submit, and follow a herd management plan. Makes other updates and amendments to the reportable diseases in the animals rule and the swine health rules. Questions and comments concerning the proposed rule may be sent to the Small Business Regulatory Coordinator for this rule. Statutory authority: IC 15-17-3; IC 15-17-10.

Resources available to regulated entities through the small business ombudsman include the ombudsman's duties stated in IC 4-4-35-8, specifically IC 4-4-35-8(9), investigating and attempting to resolve any matter regarding compliance by a small business with a law, rule, or policy administered by a state agency, either as a party to a proceeding or as a mediator.
