DIGEST

Temporarily amends 312 IAC 9-3-2 by clarifying hunter orange requirements during the special antlerless deer season. Temporarily amends 312 IAC 9-3-3 by adding the recurve bow to the list of archery equipment that can be used to hunt deer in the archery season. Temporarily amends 312 IAC 9-3-4 to govern hunting white-tailed deer in a designated county under an extra deer license by identifying counties for herd reduction. Effective September 1, 2012.


SECTION 1. (a) This SECTION supplements 312 IAC 9-3-2(s) and governs the activities of an individual who is hunting deer.

(b) An individual must wear hunter orange only in the counties where the special bonus antlerless season is authorized by 312 IAC 9-3-4(h) from December 26, 2012, through January 6, 2013.

SECTION 2. (a) This SECTION supplements 312 IAC 9-3-2(t) and governs the activities of an individual who is hunting deer.

(b) A ground blind that is occupied must contain a minimum of one hundred forty-four (144) square inches of material on each side that is solid hunter orange and is visible from any direction only in the counties where hunting is authorized during the special bonus antlerless season authorized by 312 IAC 9-3-4(h) from December 26, 2012, through January 6, 2013.

SECTION 3. (a) This SECTION supersedes 312 IAC 9-3-3(b) and governs the activities of an individual who is hunting deer during the archery season.

(b) During the archery season established in 312 IAC 9-3-4(c) of this rule, an individual must hunt deer only with the following equipment:
(1) A long bow, recurve bow, or compound bow that has at least thirty-five (35) pounds pull with a valid license identified at 312 IAC 9-3-2(f) of this rule.
(2) A crossbow with a valid license identified at 312 IAC 9-3-2(g) of this rule.
(3) Arrows or bolts must be equipped with metal or metal-edged (or flint, chert, or obsidian napped) broadheads.
(4) Poisoned or explosive arrows or bolts are unlawful.
(5) For long bows, recurve bows, and compound bows:
(A) bows drawn, held, or released other than by hand or hand-held releases are unlawful; and
(B) no portion of the bow's riser (handle) or any:
(i) track;
(ii) trough;
(iii) channel;
(iv) arrow rest; or
(v) other device;
that attaches to the bow's riser shall contact, support, or guide the arrow from a point rearward of the bow's brace height.

SECTION 4. (a) This SECTION supplements 312 IAC 9-3-4(g) and governs hunting deer under an extra deer license in a designated county.

(b) A person may take an antlerless deer under this SECTION of this document only if:
(1) issued a license to hunt deer with:
(A) a resident extra deer bonus antlerless license under IC 14-22-11-10(a) or IC 14-22-12-1(a)(18);
(B) a nonresident extra deer bonus antlerless license under IC 14-22-12-1(a)(19);
(C) a resident youth consolidated hunting license under IC 14-22-11-10(b) or IC 14-22-12-1(a)(24);
(D) a nonresident youth extra deer bonus antlerless license under IC 14-22-12-1(a)(32);
(E) an apprentice license of the types identified in clauses (A) through (D) under IC 14-22-12-1.7;
(F) a lifetime comprehensive hunting license under IC 14-22-12-7(a)(4); or
(G) a lifetime comprehensive hunting and fishing license under IC 14-22-12-7(a)(5); or
(2) hunting deer without a license under IC 14-22-11-1 and 312 IAC 9-2-14.

(c) The season for hunting deer under this SECTION of this document is as follows:
(1) From October 1, 2012, through January 6, 2013, with a bow and arrow.
(2) From November 17, 2012, through December 2, 2012, with a firearm.
(3) From December 8, 2012, through December 23, 2012, with a muzzleloading gun.

(d) The seasonal limit for hunting under this SECTION of this document is one (1) antlerless deer for each deer license issued under this SECTION of this document.

(e) An individual who hunts under this SECTION of this document may use bow and arrows, crossbow, or any firearms that may otherwise be lawfully used to take deer under 312 IAC 9-3.

(f) 312 IAC 9-3-2(b) through 312 IAC 9-3-2(d) and 312 IAC 9-3-2(m) through 312 IAC 9-3-2(z) apply to a license issued under this SECTION of this document.

(g) An individual must not exceed the county bag limit from each county as follows:

A county bag limit of "A", as used in this subsection of this document, is one (1) antlerless deer. Notwithstanding subsection (d), a deer taken in a county with a bag limit of "A" must be taken only from November 29, 2012, through January 6, 2013.

(h) The extra deer bonus antlerless license authorized by this SECTION of this document do not apply to the following properties:
(1) Atterbury Fish and Wildlife Area.
(2) Blue Grass Fish and Wildlife Area.
(3) Chinook Fish and Wildlife Area.
(4) Crosley Fish and Wildlife Area.
(5) Deer Creek Fish and Wildlife Area.
(6) Francis Slocum State Forest.
(7) Glendale Fish and Wildlife Area.
(8) Goose Pond Fish and Wildlife Area.
(9) Hillenbrand Fish and Wildlife Area.
(10) Interlake State Recreation Area.
(11) Kingsbury Fish and Wildlife Area.
(12) LaSalle Fish and Wildlife Area.
(13) Mississinewa Lake (including adjacent lands administered by the department of natural resources).
(14) Patoka Lake, except east of State Road 145 (in Orange County and Crawford County) and south of State Road 164 (in Dubois County and Crawford County).
(15) Pigeon River Fish and Wildlife Area.
(16) Roush Lake Fish and Wildlife Area.
(17) Salamonie Lake (including adjacent lands administered by the department of natural resources).
(18) Salamonie River State Forest.
(19) Splinter Ridge Fish and Wildlife Area.
(20) Stucker Fork Fish and Wildlife Area.
(21) Sugar Ridge Fish and Wildlife Area.
(22) Tri-County Fish and Wildlife Area.
(23) Wabashiki Fish and Wildlife Area.
(24) Wilbur Wright Fish and Wildlife Area.
(25) Winamac Fish and Wildlife Area.

(i) The extra deer bonus antlerless license authorized by this SECTION of this document does not apply to the department properties listed in this subsection from November 17, 2012, through November 28, 2012:
(1) Hovey Lake Fish and Wildlife Area.
(2) Jasper-Pulaski Fish and Wildlife Area.
(3) Kankakee Fish and Wildlife Area.
(4) Minnehaha Fish and Wildlife Area.

(j) The extra deer bonus antlerless license authorized by this SECTION of this document does not apply to the department properties listed in this subsection from November 17, 2012, through December 2, 2012:
(1) Anspaugh Wetland Conservation Area.
(2) Cedar Swamp Wetland Conservation Area.
(3) Curtis Wetland Conservation Area.
(4) Deniston Resource Area.
(5) Durham Lake Wetland Conservation Area.
(6) Eagle Lake Wetland Conservation Area.
(7) Goose Lake Wetland Conservation Area.
(8) Greene-Sullivan State Forest.
(9) Hillenbrand Fish and Wildlife Area.
(10) Jimmerson Wetland Conservation Area.
(11) Mallard Roost Wetland Conservation Area.
(12) Marsh Lake Wetland Conservation Area.
(13) Mendenhall Wetland Conservation Area.
(14) Rome City Wetland Conservation Area.
(15) Ropchan Wetland Conservation Area.
(16) Splinter Ridge Fish and Wildlife Area.

(k) The extra deer bonus antlerless license authorized by this SECTION of this document does not apply to Fairbanks Landing Fish and Wildlife Area from October 1, 2012, through November 28, 2012, and from December 3, 2012, through January 6, 2013.

SECTION 5. SECTIONS 1 through 4 of this document expire on February 1, 2013.
