TITLE 290 DEPARTMENT OF HOMELAND SECURITY

Notice of Intent to Adopt a Rule

Under IC 4-22-2-23, the Department of Homeland Security intends to adopt a rule concerning the following:

OVERVIEW: Adds 290 IAC 2. Replaces the emergency rule that is currently in effect. The intent of the proposed rule is to implement and interpret IC 36-8-21.5 and to describe the procedural requirements of the agency concerning severe weather warning sirens. The scope of the proposed rule includes definitions of terms, purpose, scope, and applicability of the rule, minimum technical standards for sirens, activation protocols, siren audibility and installation standards, conditions for activation of sirens, siren coverage report content and submission to the agency, development and adoption by a county of a siren coverage plan. Effective 30 days after filing with the Publisher. Statutory authority: IC 36-8-21.5.

Resources available to regulated entities through the small business ombudsman include the ombudsman's duties stated in IC 5-28-17-5, specifically IC 5-28-17-5(9), investigating and attempting to resolve any matter regarding compliance by a small business with a law, rule, or policy administered by a state agency, either as a party to a proceeding or as a mediator.
