TITLE 65 STATE LOTTERY COMMISSION

Emergency Rule

DIGEST

Amends 65 IAC 1-1-1 regarding definitions of terms used throughout the article. Adds 65 IAC 7 regarding general rules that apply to lottery games and the specific draw game rules. Adds 65 IAC 8 regarding prize claims, ticket validations, and prize payment in lottery games. Repeals 65 IAC 4, 65 IAC 5, 65 IAC 6, and LSA Document #10-53(E). Effective August 10, 2010.



SECTION 1. 65 IAC 1-1-1 IS AMENDED TO READ AS FOLLOWS:

65 IAC 1-1-1 Definitions

Sec. 1. (a) The definitions in IC 4-30-2 and in this section apply throughout this title.

(b) "Applicant" means a person who has submitted an application to receive a certificate of authority to contract with the commission as a retailer.

(c) "Central computer" means a computer system designated to control, monitor, and communicate with the terminals and to record the plays and transactions processed by the terminals.

(c) (d) "Chair" means the chairperson of the commission selected pursuant to IC 4-30-4-3.

(d) (e) "Commission" means the state lottery commission created by IC 4-30, doing business as the Hoosier Lottery. In order to differentiate the commission from agencies and commissions created in other states, the commission may use the name "The State Lottery Commission of Indiana" in the execution of agreements, contracts, and other documentation.

(f) "Director" has the meaning set forth in IC 4-30-2-3.

(e) (g) "Draw game" means a lottery game distributed through retailer-located terminals which are connected to a central computer by a communications network. in which a player selects a combination of numbers or symbols, either manually or by a quick pick, and winning tickets are determined by appropriately matching the combination of numbers or symbols randomly selected by the commission at a designated future drawing or selection event.

(h) "Game play data area" means an area on a:
(1) scratch-off ticket covered with a latex or other covering; or
(2) a pull-tab ticket covered with one (1) or more tabs;
which, when uncovered, reveals play or prize symbols, bar codes, verification codes, or other means for determining the outcome of game play on that ticket.

(i) "Major procurement" has the meaning set forth in IC 4-30-2-5.

(f) (j) "Member" means a member of the commission, as described in IC 4-30-3-1.

(k) "MUSL" means the Multi-State Lottery Association, a government-benefit association wholly owned and operated by member commissions, state agencies, and other political subdivisions, which are authorized to conduct lottery games.

(l) "On-line game" means a game where participation in the game is recorded on a computer-generated ticket distributed through terminals connected to a central computer by a communications network.

(m) "Pari-mutuel prize" means a prize equal to the total amount of the winnings pool available for prizes of that type divided by the total number of winning tickets for that prize.

(g) (n) "Person" means any individual, firm, association, joint venture, partnership, estate, trust, syndicate, fiduciary, corporation, or other group or combination, and includes any agency or political subdivision of the state. has the meaning set forth in IC 4-30-2-6.

(o) "Play slip" means a form prescribed by the commission on which a player may hand mark the player's desired numbers, symbols, or other characters and which is input into a terminal to generate a ticket for a lottery game.

(p) "Play symbol" means an alphabetic, numeric, or graphic character or symbol appearing in the game play data area of a ticket which is used to determine whether the player won a prize.

(q) "Prize symbol" means numeric symbol expressed in terms of United States currency appearing in the game play data area of a ticket and used to determine the value of a possible prize.

(r) "Prize winner" means any individual or other person ultimately entitled to receive full or partial payment of a lottery prize either directly or by means of a pass through entity, including, but not limited to, the:
(1) beneficiaries of a trust;
(2) partners, members, or shareholders of a business entity;
(3) individual members of a group, club, or association; or
(4) assigned guardian or adult member of a minor's family functioning as a custodian for a person who is less than eighteen (18) years of age and claiming a prize on a lawfully purchased ticket.

(h) (s) "Pull-tab game" means a lottery game that offers preprinted tickets on which one (1) or more tabs are opened to reveal immediately whether the player has won a prize.

(t) "Quick pick" means any numbers or symbols randomly generated by a terminal to compose or complete a play in a lottery game.

(u) "Retailer" has the meaning set forth in IC 4-30-2-7.

(i) (v) "Scratch-off game" means a lottery game that offers preprinted lottery tickets that, after a covering is rubbed off, removed, immediately reveals numbers, play symbols, or other insignia of whether the player has won a prize.

(j) "Scratch-off prize" means a prize awarded in connection with a scratch-off game but not a prize awarded pursuant to 65 IAC 4-3-7 or 65 IAC 4-3-10.

(w) "Selection event" means a drawing or other random selection of the winning numbers or play symbols in a lottery game.

(k) (x) "Terminal" means a device which is authorized by the commission to function in an interactive mode with a central computer system for the purpose of issuing draw game lottery tickets and entering, receiving, and processing lottery transactions.

(y) "Vendor" has the meaning set forth in IC 4-30-2-8.

ARTICLE 7. LOTTERY GAMES


Rule 1. General Provisions


65 IAC 7-1-1 Applicability

Sec. 1. This article applies to all lottery games unless the rule or rules applicable to a specific lottery game are in conflict with this article, in which case the rule or rules applicable to the specific lottery game shall control for that game.

65 IAC 7-1-2 Compliance with law and procedures

Sec. 2. Any person who purchases a ticket in a lottery game agrees thereby to comply with and abide by IC 4-30, this title, and all procedures, instructions, and final decisions of the director in connection with the conduct of the lottery game for which the ticket is purchased.

65 IAC 7-1-3 Game rules

Sec. 3. (a) The director, or the director's designee, is authorized to develop and promulgate game rules and procedures for specific lottery games on behalf of the commission.

(b) Any game rules created under subsection (a) shall:
(1) include the necessary criteria or conditions for winning a prize; and
(2) be published and available for all players.

(c) The director, or the director's designee, shall advise the commission of the contents of any rules and procedures promulgated under this section at the commission's next regular meeting.

65 IAC 7-1-4 Availability of instant tickets

Sec. 4. The availability of tickets for sale in a scratch-off or pull-tab game depends on retailer orders for tickets. Not all scratch-off or pull-tab tickets may be made available for sale prior to game closing and opened packs of scratch-off tickets may be returned by a retailer to the lottery under 65 IAC 3-4-1(a).

65 IAC 7-1-5 Termination of a game

Sec. 5. (a) The director may suspend or terminate any game without advance notice if such suspension or termination is in the best interest of the lottery.

(b) A scratch-off or pull-tab game will end when all tickets for that game have been sold or on a date determined by the director or the director's designee. A scratch-off or pull-tab game may be closed prior to all prizes being awarded.

(c) If the director or the director's designee determines an end date for a scratch-off or pull-tab game, tickets in that game may remain on sale during the game closing process in accordance with the policies of the director even if all prizes have been claimed.

(d) All sales of tickets in a draw game must cease immediately or at the time specified by the director or the director's designee if that draw game is suspended or terminated.

65 IAC 7-1-6 Multi-draw tickets

Sec. 6. (a) Unless the rule for a specific game provides otherwise, the commission may offer multi-draw tickets in a draw game that are valid for a designated number of consecutive selection events.

(b) A multi-draw ticket may specify the first selection event for which it is valid or, if no selection event is so specified, shall be valid for the next selection event held after the multi-draw ticket is purchased for that game.

(c) A multi-draw ticket may be canceled by the commission at any time. If a multi-draw ticket is canceled by the commission, the owner will be issued a refund for the pro rata portion of the purchase price of the ticket applicable to future selection events or will be issued substitute tickets equal in purchase price to the pro rata portion of the purchase price of the multi-draw ticket applicable to future selection events for the same or a comparable game, at the discretion of the director.

(d) The commission may conduct multiple selection events during any week, and multi-draw tickets shall be valid for a particular number of selection events rather than a particular period of time.

65 IAC 7-1-7 Cancellation by a player

Sec. 7. (a) Unless the rule for a specific game provides otherwise and except as provided in subsection (b), an on-line ticket may be cancelled on the terminal that generated the ticket.

(b) An on-line ticket cannot be cancelled if:
(1) more than sixty (60) minutes has passed since the time the ticket was purchased; or
(2) the closing time for the selection event for which the ticket was purchased has passed.

(c) If a ticket is cancelled in accordance with this section, the player is entitled to a refund from the retailer of money paid for the ticket.

65 IAC 7-1-8 Prize drawings; selection events

Sec. 8. (a) Any selection event for a draw game shall be conducted as provided in this section.

(b) Selection events to award prizes shall be conducted periodically as determined by the director or as provided in the rule applicable to a specific game.

(c) The director or the director's designee shall determine and announce the dates, times, and procedures for selection events to select prize winning characters or symbols for each draw game, consistent with the specific game rules for that game and with this article.

(d) All selection events in a draw game shall be:
(1) open to the public; and
(2) witnessed by an independent certified public accountant.

(e) Disputes regarding the rules or procedures for a selection event shall be resolved by the director in the exercise of the director's sole discretion.

(f) If the director finds that it is in the best interests of the lottery or the public, the director may:
(1) reasonably postpone any selection event to a future time and immediately publicize the postponement; or
(2) substitute the selection event of another state-run lottery as long as the substitute selection event is reasonably equivalent to the selection event being replaced in terms of game play, randomness, and reliability.

(g) The director, or the director's designee, shall advise the commission of the details of any action taken under subsection (g) [sic] at the commission's next regular meeting.

(h) The commission, the director, and the commission's employees shall have no liability for circulation, publication, or broadcast of incorrect winning numbers with respect to a selection event.

65 IAC 7-1-9 Ticket liabilities

Sec. 9. (a) A lottery ticket is a bearer instrument until it is signed by the owner or owners in the designated area of the ticket. If a ticket is properly signed, the person whose signature appears on the ticket shall be the owner of the ticket and entitled to any prize attributable thereto, except that a pull-tab ticket remains at all times a bearer instrument and shall be owned by the physical possessor of the ticket unless the prize is:
(1) exceeds five hundred ninety-nine dollars ($599); and
(2) a space has been designated on the ticket for a signature.

(b) The owner or owners of a lottery ticket are responsible for and bear the sole risk of loss or theft of the ticket.

(c) A retailer acts on behalf of the player when entering information into a terminal to produce lottery tickets, and it is the sole responsibility of the player to verify the accuracy of all game information printed on the ticket. In the event of any error, the player's only remedy is cancellation of the ticket in accordance with section 7 of this rule, unless the rule for a specific game provides otherwise.

(d) The commission, the director, and the commission's employees have no responsibility or liability for tickets printed in error or for tickets intentionally or inadvertently canceled by a retailer.

(e) After a retailer accepts delivery of a pull-tab ticket, the retailer bears the sole risk of loss, damage, or theft of the pull-tab ticket until the pull-tab ticket is sold by the retailer to a player.

(f) All holders of a lottery game ticket shall be deemed to have agreed to all rules and procedures of the commission by their purchase of the ticket.

Rule 2. Daily 3 Game Rule


65 IAC 7-2-1 Name

Sec. 1. The collective name of the draw games conducted pursuant to this rule is "Daily 3". As used in this rule, the term "Daily 3" shall include both Daily 3 – Evening and Daily 3 – Midday unless context requires otherwise.

65 IAC 7-2-2 Independent draw games

Sec. 2. (a) Daily 3 shall be conducted as two (2) separate and independent draw games designated Daily 3 – Evening and Daily 3 – Midday, respectively. Tickets in the Daily 3 – Evening game are not associated with the Daily 3 – Midday game and vice versa. The two (2) games shall have separate selection events, winning numbers, and prizes. Notwithstanding the foregoing, the odds, play styles, and prize amounts shall be identical in both Daily 3 games.

(b) A multi-draw ticket in the Daily 3 – Evening game shall be for the next consecutive Daily 3 – Evening selection event(s) following the first selection event for which the ticket is valid, and a multi-draw ticket in the Daily 3 – Midday game shall be for the next consecutive Daily 3 – Midday selection event(s) following the first selection event for which the ticket is valid. If the player elects to make a wager in both the Daily 3 – Midday and Daily 3 – Evening games and requests a multi-draw ticket, the multi-draw option shall apply to the next consecutive selection event(s) of both the Daily 3 – Evening and Daily 3 – Midday games.

65 IAC 7-2-3 Definitions

Sec. 3. (a) The definitions in this section apply throughout this rule.

(b) "Box play" means a wager that the three (3) digits selected by the player will match the winning numbers drawn by the commission in a specified selection event in any order.

(c) "Combo play" means a wager that is split evenly between a straight play and a box play.

(d) "Daily 3 – Evening" means the Daily 3 game associated with selection events conducted in the evening.

(e) "Daily 3 – Midday" means the Daily 3 game associated with selection events conducted in the afternoon.

(f) "Straight play" means a wager that the three (3) digits selected by the player will be drawn by the commission during a specified selection event in the exact order that the digits were selected by the player.

(g) "Winning numbers" means three (3) numbers between and including zero (0) and nine (9) drawn by the commission in a specific order in a Daily 3 – Evening or Daily 3 – Midday selection event.

65 IAC 7-2-4 Ticket price

Sec. 4. A wager for one (1) play for Daily 3 – Midday or Daily 3 – Evening must be made in increments of one dollar ($1) and shall not exceed ten dollars ($10).

65 IAC 7-2-5 Procedure for playing

Sec. 5. (a) A single play, applicable to a particular selection event for either Daily 3 – Midday or Daily 3 – Evening, shall include the selection of:
(1) the amount wagered under section 4 of this rule;
(2) three (3) digits in a specified order, with each digit ranging from zero (0) to nine (9); and
(3) a play type from the following:
(A) straight play;
(B) box play; or
(C) combo play.

(b) A valid ticket for Daily 3 – Midday or Daily 3 – Evening must originate from the commission. A ticket may only be issued after the information and purchaser elections required by this rule are entered into a terminal.

(c) A ticket is the only valid proof of a play and the only valid receipt for claiming a prize resulting from a Daily 3 – Midday or Daily 3 – Evening selection event. A play slip shall have no pecuniary or prize value and shall not constitute evidence of purchase of a ticket or a play.

(d) A ticket is only effective for the selection event or events indicated on the ticket. If a purchaser fails to specifically request Daily 3 – Evening or Daily 3 – Midday, the retailer may issue a ticket for the next scheduled drawing. Subject to the restrictions of 65 IAC 7-1-6, the commission may offer multi-draw tickets for Daily 3 – Evening or Daily 3 – Midday selection events which are effective for up to twenty-eight (28) consecutive selection events. Daily 3 multi-draw tickets are limited to the game for which they were purchased unless the player elects to apply multi-draw to both the Daily 3 – Evening and Daily 3 – Midday selection events.

(e) Sales of tickets for Daily 3 selection events shall be suspended prior to the time of the associated selection event at a time determined by the director.

(f) Sales of tickets containing a particular play shall be suspended if the total liability of the commission for winning tickets containing that play would exceed an amount established by the director or the director's designee. No person shall be entitled to purchase a ticket containing any particular play if such play has been suspended, and neither the commission, the director, nor any employee of the commission shall be liable for the inability of any person to purchase a ticket containing a particular play.

(g) Entry coupons may be generated by terminals for certain purchases of tickets for Daily 3.

65 IAC 7-2-6 Determination of winners

Sec. 6. (a) Selection events for determination of winning numbers in Daily 3 – Evening shall be held each day. Selection events for determination of winning numbers in Daily 3 – Midday shall be held on Monday through Saturday afternoons.

(b) Each selection event in a Daily 3 game shall:
(1) be conducted in accordance with 65 IAC 7-1-8 at a time to be determined by the director or the director's designee;
(2) determine three (3) winning numbers between and including zero (0) and nine (9); and
(3) determine the order that the three (3) winning numbers were selected.

(c) A valid one dollar ($1) wager on a Daily 3 selection event for a:
(1) Straight play that matches the three (3) winning numbers in exact order wins a prize of five hundred dollars ($500).
(2) Box play that:
(A) Matches the three (3) winning numbers in any order and all three (3) digits are unique (commonly referred to as six-way box play or, for example, "3 – 5 – 8") wins a prize of eighty dollars ($80).
(B) Matches the three (3) winning numbers in any order and two (2) digits are unique with one (1) digit repeating (commonly referred to as three-way box play or, for example, "3 – 5 – 3") wins a prize of one hundred sixty dollars ($160).
(3) Combo play that:
(A) Matches the three (3) winning numbers in any order and all three (3) digits are unique (commonly referred to as a six-way combo play or, for example, "3 – 5 – 8") wins a prize of forty dollars ($40).
(B) Matches the three (3) winning numbers in any order and two (2) digits are unique with one (1) digit repeating (commonly referred to as three-way combo play or, for example, "3 – 5 – 3") wins a prize of eighty dollars ($80).
(C) Matches the three (3) winning numbers in exact order and all three (3) digits are unique, for example, "3 – 5 – 8", wins a prize of two hundred ninety dollars ($290).
(D) Matches the three (3) winning numbers in exact order and two (2) digits are unique with one (1) digit repeating, for example, "3 – 5 – 3", wins a prize of three hundred thirty dollars ($330).

(d) If a play eligible for a prize under this section was purchased for more than one dollar ($1), the prize specified in this section shall be multiplied by a factor equal to the price of the play divided by one dollar ($1).

65 IAC 7-2-7 Odds of winning

Sec. 7. (a) The odds of winning a prize of five hundred dollars ($500) in a Daily 3 selection event with a straight play are approximately 1:1,000.

(b) The odds of winning a prize of eighty dollars ($80) in a Daily 3 selection event with a box play, in which all three (3) numbers are unique, for example, "3 – 5 – 8", are approximately 1:167.

(c) The odds of winning a prize of one hundred sixty dollars ($160) in a Daily 3 selection event with a box play, in which two (2) digits are unique with one (1) digit repeating, for example, "3 – 5 – 3", are approximately 1:333.

(d) The odds of winning a prize of forty dollars ($40) in a Daily 3 selection event with a one dollar ($1) combo play, in which all three (3) numbers are unique, for example, "3 – 5 – 8", and match in any order, are approximately 1:200.

(e) The odds of winning a prize of eighty dollars ($80) in a Daily 3 selection event with a one dollar ($1) combo play, in which two (2) digits are unique with one (1) digit repeating, for example, "3 – 3 – 5", and match in any order, are approximately 1:500.

(f) The odds of winning a prize of two hundred ninety dollars ($290) in a Daily 3 selection event with a one dollar ($1) combo play, in which all three (3) numbers are unique, for example, "3 – 5 – 8", and match in exact order, are approximately 1:1,000.

(g) The odds of winning a prize of three hundred thirty dollars ($330) in a Daily 3 selection event with a one dollar ($1) combo play, in which two (2) digits are unique with one (1) digit repeating, for example, "3 – 3 – 5", and match in exact order, are approximately 1:1,000.

Rule 3. Daily 4 Game Rule

65 IAC 7-3-2 Independent games

Sec. 2. (a) Daily 4 shall be conducted as two (2) separate and independent games designated Daily 4 – Evening and Daily 4 – Midday, respectively. Tickets in the Daily 4 – Evening game are not associated with the Daily 4 – Midday game and vice versa. The two (2) games shall have separate selection events, winning numbers, and prizes. Notwithstanding the foregoing, the odds, play styles, and prize amounts shall be the same in all Daily 4 selection events.

(h) "Straight play" means either:
(1) a wager that the four (4) digits selected by the player will match the winning numbers drawn by the commission during a specified selection event in the exact order that the digits were selected by the player; or
(2) a wager that the three (3) digits selected by the player in a front 3 or back 3 play will match the winning numbers drawn by the commission during a specified selection event in the exact order that the digits were selected by the player.

(i) "Winning numbers" means four (4) digits between and including zero (0) and nine (9), drawn by the commission in a specific order in a Daily 4 – Evening or Daily 4 – Midday selection event or, in the case of a front 3 or back 3 play, only the first or last three (3) digits selected, respectively.

Sec. 5. (a) A single play, applicable to a particular selection event for Daily 4 – Midday or Daily 4 – Evening, shall include the selection of:
(1) The amount wagered under section 4 of this rule.
(2) A game type from the following:
(A) Daily 4.
(B) Front 3.
(C) Back 3.
(3) A play type from the following:
(A) straight play;
(B) box play; or
(C) combo play.
(4) Either three (3) or four (4) digits, depending on the selection in subdivision (2), in a specified order, with each digit ranging from zero (0) to nine (9).

(b) A ticket for Daily 4 – Midday or Daily 4 – Evening must originate from the commission. A ticket may only be issued after the information and player elections required by this rule are entered into a terminal.

(c) A ticket is the only valid proof of a play and the only valid receipt for claiming a prize in Daily 4. A play slip shall have no pecuniary or prize value and shall not constitute evidence of purchase of a ticket or a play.

(d) A ticket is effective for the selection event indicated on the ticket. If a purchaser fails to specifically request Daily 4 –Evening or Daily 4 – Midday, the retailer may issue a ticket for the next scheduled drawing. Subject to the restrictions of 65 IAC 7-1-6, the commission may offer multi-draw tickets for Daily 4 – Evening or Daily 4 – Midday selection events which are effective for up to twenty-eight (28) consecutive selection events. Daily 4 multi-draw tickets are limited to the game for which they were purchased unless the player elects to apply multi-draw to both the Daily 4 – Evening and Daily 4 – Midday selection events.

(e) Sales of tickets for Daily 4 selection events shall be suspended prior to the time of the associated selection event at a time determined by the director.

(f) Sales of tickets containing a particular play shall be suspended if the total liability of the commission for winning tickets containing that play would exceed an amount established by the director. No person shall be entitled to purchase a ticket containing any particular play if such play has been suspended, and neither the commission, the director, nor any employee of the commission shall be liable for the inability of any person to purchase a ticket containing a particular play.

(g) Entry coupons may be generated by terminals for certain purchases of tickets for Daily 4.

(A) in accordance with 65 IAC 7-1-8; and

(d) Unless otherwise indicated on the ticket, a ticket for Lucky 5 – Evening is effective for the next scheduled Lucky 5 – Evening selection event. Unless otherwise indicated on the ticket, a ticket for Lucky 5 – Midday is effective for the next scheduled Lucky 5 – Midday selection event. If a purchaser fails to specifically request Lucky 5 – Evening or Lucky 5 – Midday, the retailer may issue a ticket for the next scheduled drawing. Subject to the restrictions of 65 IAC 7-1-6, the commission may offer multi-draw tickets for Lucky 5 which are effective for the following numbers of selection events:
(1) Two (2).
(2) Three (3).
(3) Four (4).
(4) Five (5).
(5) Ten (10).
(6) Twenty-eight (28).
Lucky 5 multi-draw tickets are limited to the games for which they were purchased and cannot alternate between Lucky 5 – Evening and Lucky 5 – Midday selection events.

(e) Sales of tickets for Lucky 5 selection events shall be suspended prior to the time of the associated selection event at a time determined by the director.

(f) Sales of tickets for a Lucky 5 selection event containing a particular board may be suspended if the total liability of the commission for winning tickets containing that board would exceed an amount established by the director. No person shall be entitled to purchase an ticket containing any particular board if such board has been suspended, and neither the commission, the director, nor any employee of the commission shall be liable for the inability of any person to purchase a ticket containing a particular board.

(g) If a play slip is used to select a player's numbers for a Lucky 5 selection event, the play slip must have been issued by the lottery and completed by hand by the player. The play slip will be scanned by the terminal or, in the event of a problem, keyed in by hand.

(h) The director may provide for the generation of entry tickets from terminals for certain purchases of tickets for Lucky 5.

65 IAC 7-5-2 Definitions

Sec. 2. (a) The definitions in this section apply throughout this rule.

(b) "Board" means three (3) lines of five (5) numbers for a total of fifteen (15) numbers ranging from one (1) to fifty (50). You could have up to five (5) boards on a single Mix & Match ticket.

(c) "Winning Mix & Match numbers" means the five (5) numbers determined in a specific Mix & Match selection event and announced as such pursuant to section 8 of this rule.

65 IAC 7-5-4 Procedure for playing

Sec. 4. (a) A single play, applicable to a particular selection event for Mix & Match, shall include:
(1) the player selection or quick pick of five (5) numbers ranging from one (1) to fifty (50); and
(2) the automated quick pick of two (2) additional lines of five (5) numbers with each line ranging from one (1) to fifty (50).

(b) A valid ticket for a Mix & Match selection event must originate from the commission. A ticket may only be issued after the information and purchaser elections required by this rule are entered into a terminal.

(c) A ticket is the only valid proof of a board and the only valid receipt for claiming a prize resulting from a Mix & Match selection event. A play slip shall have no pecuniary or prize value and shall not constitute evidence of purchase of a ticket or a board.

(d) Unless otherwise indicated on the ticket, a ticket for Mix & Match is effective for the next scheduled Mix & Match selection event either Tuesday or Friday evening. The commission may offer multi-draw tickets for Mix & Match which are effective for any number of sequential drawings between two (2) and ten (10).

(e) Sales of tickets for Mix & Match selection events shall be suspended prior to the time of the associated selection event at a time determined by the director.

(f) If a play slip is used to select a player's numbers for a Mix & Match selection event, the play slip must have been issued by the lottery and completed by hand by the player. The play slip will be scanned by the terminal or, in the event of a problem, keyed in by hand.

(g) The director may provide for the generation of entry tickets from terminals for certain purchases of tickets for Mix & Match.

65 IAC 7-5-5 Determination of winning numbers

Sec. 7. (a) Each holder of a valid ticket for a Mix & Match selection event on which five (5) numbers in a single line applicable to that selection event match the five (5) winning Mix & Match numbers is entitled to the top prize as calculated in section 7 [sic] of this rule.

(b) Each holder of a valid ticket for a Mix & Match selection event on which four (4) numbers in a single line applicable to that selection event match four (4) winning Mix & Match numbers is entitled to a prize of five hundred dollars ($500).

(c) Each holder of a valid ticket for a Mix & Match selection event on which three (3) numbers in a single line applicable to that selection event match three (3) winning Mix & Match numbers is entitled to a prize of ten dollars ($10).

(d) Each holder of a valid ticket for a Mix & Match selection event on which eight (8) or more of fifteen (15) numbers in combined lines on a single board is entitled to a prize of five thousand dollars ($5,000).

(e) Each holder of a valid ticket for a Mix & Match selection event on which seven (7) of fifteen (15) numbers in combined lines on a single board is entitled to a prize of three hundred and fifty dollars ($350).

(f) Each holder of a valid ticket for a Mix & Match selection event on which six (6) of fifteen (15) numbers in combined lines on a single board is entitled to a prize of fifty dollars ($50).

(g) Each holder of a valid ticket for a Mix & Match selection event on which five (5) of fifteen (15) numbers in combined lines on a single board is entitled to a prize of twenty-five dollars ($25).

(h) Each holder of a valid ticket for a Mix & Match selection event on which four (4) of fifteen (15) numbers in combined lines on a single board is entitled to a prize of five dollars ($5).

(i) Each holder of a valid ticket for a Mix & Match selection event on which three (3) of fifteen (15) numbers in combined lines on a single board is entitled to a prize of one (1) free Mix & Match quick pick ticket.

(d) Unless otherwise indicated on the draw ticket, a draw ticket for Quick Draw is effective for the next scheduled Quick Draw selection event.

(e) The commission may offer multi-draw tickets for Quick Draw. The selection of the multi-draw option on a play slip will apply to all boards played on that play slip.

(f) A ticket for Quick Draw shall be cancelable for up to sixty (60) minutes after the transaction or up to the Quick Draw selection event cutoff time, whichever is first. The draw ticket for Quick Draw can only be cancelled by the terminal from which it was sold.

(g) The director may provide for the generation of entry tickets from terminals for certain purchases of tickets for Quick Draw.

(d) Each holder of a valid ticket for a Quick Draw selection event on which seven (7) numbers in a single play match the Quick Draw winning numbers for that selection event is entitled to a prize of fifty dollars ($50).

(e) Each holder of a valid ticket for a Quick Draw selection event on which six (6) numbers in a single play match the Quick Draw winning numbers for that selection event is entitled to a prize of fifteen dollars ($15).

(f) Sales of tickets for Hoosier Lotto shall be suspended prior to the time of each Hoosier Lotto selection event at a time determined by the director.

(g) If a play slip is used to select a player's numbers for a Hoosier Lotto selection event, the play slip must have been issued by the lottery and completed by hand. The play slip will be scanned by the terminal or keyed in by hand by the retailer.

(h) The director may provide for the generation of entry tickets from terminals for certain purchases of tickets for Hoosier Lotto.

65 IAC 7-7-6 Estimated annuity jackpot amount

Sec. 6. (a) The director or the director's designee shall announce the estimated annuity jackpot amount prior to each Hoosier Lotto selection event.

(b) The estimated annuity jackpot amount for a particular Hoosier Lotto selection event shall include:
(1) one million dollars ($1,000,000) in the first and second consecutive selection events following the last selection event in which a player won the jackpot prize; and
(2) an additional five hundred thousand dollars ($500,000) for each consecutive selection event after the second selection event following the last selection event in which a player won the jackpot prize.

65 IAC 7-7-7 Determination of single payment prize amounts

Sec. 7. (a) The lump sum jackpot amount applicable to a particular Hoosier Lotto selection event shall include:
(1) seventy-four and eight-tenths percent (74.8%) of the winnings pool for the selection event; and
(2) the lump sum jackpot amounts, if any, applicable to selection events preceding the particular selection event and following the last selection event in which players won the jackpot prize.

(b) Four and two-tenths percent (4.2%) of the winnings pool shall be allocated among players who have matched five (5) of the six (6) winning Hoosier Lotto numbers.

(c) Nine percent (9%) of the winnings pool shall be allocated among players who have matched four (4) of the six (6) winning Hoosier Lotto numbers.

(d) The remaining balance of the winnings pool shall first be applied to the set prizes of three dollars ($3) paid to players who have matched three (3) of the six (6) winning Hoosier Lotto numbers.

(e) The winnings pool is not affected by set prizes of free quick picks for a future Hoosier Lotto drawing, which is awarded to players who have matched two (2) of the six (6) winning Hoosier Lotto numbers.

(b) Each holder of a valid ticket for a Hoosier Lotto selection event on which five (5) numbers in a play applicable to that selection event match five (5) of the six (6) winning Hoosier Lotto numbers is entitled to an equal share of the allocable percentage of the winnings pool.

(c) Each holder of a valid ticket for a Hoosier Lotto selection event on which four (4) numbers in a play applicable to that selection event match four (4) of the six (6) winning Hoosier Lotto numbers is entitled to an equal share of the allocable percentage of the winnings pool.

(d) Each holder of a valid ticket for a Hoosier Lotto selection event on which three (3) numbers in a play applicable to that selection event match three (3) of the six (6) winning Hoosier Lotto numbers is entitled to a set prize of three dollars ($3).

(e) Each holder of a valid ticket for a Hoosier Lotto selection event on which two (2) numbers in a play applicable to that selection event match two (2) of the six (6) winning Hoosier Lotto numbers is entitled to a set prize of a free Hoosier Lotto quick pick in the next scheduled Hoosier Lotto selection event.

65 IAC 7-7-10 Payment options; player election

Sec. 10. (a) Players are required to select a payment option for distribution of the jackpot prize. The following payment options are available:
(1) A single lump sum payment of the jackpot amount or the player's share of the lump sum jackpot amount as calculated in section 7(a) of this rule.
(2) Thirty (30) annual payments until the total payments equal the annuity jackpot amount or the player's share of the annuity jackpot amount as estimated in section 6 of this rule.

(b) A jackpot prize claimant shall have sixty (60) days from the day the prize claimant becomes entitled to receive the jackpot amount or a share thereof to select a payment option. The election must be in writing and on a form authorized by the commission. An election under this subsection cannot be revoked, withdrawn, or otherwise modified. The election of the prize claimant shall apply to all prize winners of that jackpot prize.

(c) If a prize claimant fails to select a payment option, the jackpot amount shall be paid out in a single lump sum payment pursuant to subsection (a)(1).

(d) The commission, director, agents, or employees of the commission shall not be responsible for differences in the advertised or estimated jackpot amount or the amount paid to the player due to changes in the price of securities occurring between the drawing and payment dates.

(e) The director may, in the director's discretion and despite the player's selection, require a single lump sum payment if the winnings pool is insufficient to obtain securities for an annuity payment stream at a reasonable cost.

65 IAC 7-7-11 Payment of prizes

Sec. 11. (a) Payments arising out of the jackpot amount shall be made in accordance with the player's selected payment option in accordance with section 10 of this rule.

(b) If a valid ticket for Hoosier Lotto contains more than one (1) play entitled to a prize, the prize amounts for the winning plays shall be added together for purposes of claiming the prizes and determining whether the total prize amounts may be claimed from a retailer pursuant to 65 IAC 3-4-4.

(c) An annuity jackpot prize or any share thereof may be rounded to facilitate the purchase of an appropriate funding mechanism. Breakage (the remainder after division or rounding) on a jackpot prize shall be added to the first payment. Pari-mutuel prizes may be rounded down so that the prizes may be paid in multiples of whole dollars. Breakage resulting from rounding down pari-mutuel prizes shall be carried forward to the jackpot amount portion of the winnings pool for the next Hoosier Lotto selection event.

Rule 2. Ticket Validation; Disputes


65 IAC 8-2-1 Conditions precedent to receiving a prize

Sec. 1. In order to receive payment of a prize on a winning lottery ticket, the prize claimant bears the burden of establishing the following:
(1) The ticket was properly purchased by an eligible purchaser in accordance with IC 4-30 and this title.
(2) The ticket is a valid ticket, as described in section 2(b) of this rule, which was issued by the commission in an active game in accordance with IC 4-30 and this title.
(3) The ticket entitles the holder to a prize in accordance with the approved game specific rules, working papers, or other specifications applicable to the play of that particular lottery game.
(4) The ticket and claim for a prize meets all other applicable requirements contained in this title.

65 IAC 8-2-2 Validation of tickets

Sec. 2. (a) Any lottery ticket not passing all of the validation requirements found in IC 4-30-11-4 is void and ineligible for any prize, and no prize shall be paid thereon.

(b) For a ticket to be a valid ticket under section 1(2) of this rule, all of the following must be met:
(1) The ticket is a ticket sold directly by the commission or issued to a retailer in an authorized manner.
(2) The ticket must not be altered, torn, misprinted, illegible, defaced, or damaged in such a manner that validation is impossible.
(3) The ticket must not be reconstituted or tampered with in any manner.
(4) The ticket must not be counterfeit in whole or in part.
(5) The ticket must not be stolen nor appear on any list of omitted or cancelled tickets on file with the commission.
(6) The quantity, typeface, and artwork of play symbols, captions, or characters used as play selections must correspond with the quantity, typeface, and artwork of play symbols, captions, or characters established by the commission in approved game specific rules, working papers, or other specifications applicable to the play of that particular lottery game.
(7) Each play symbol or character must be present in its entirety and be fully legible.
(8) Each play symbol or character with a corresponding caption must agree with its caption in accordance with the game specific rules, working papers, and other specifications approved by the director or the commission for that game.
(9) The game, pack, and ticket number, if applicable, must be present in its entirety and be fully legible.
(10) The validation numbers, agent verification codes, and the game/pack/ticket numbers, if applicable, must be right-side-up, not reversed in any manner, and correspond exactly to the typeface and artwork on file with the commission for the applicable game.
(11) The display printing must be regular in every respect and correspond exactly to the artwork on file with the commission for the applicable game.
(12) The ticket must pass any additional validation test prescribed by the commission, which for security reasons may be confidential in nature.
(13) The validation number of an apparent winning scratch-off or pull-tab ticket must appear on the commission's official list of validation numbers of winning tickets, and the ticket with that validation number must not have been paid previously according to the records of the commission.

(c) In addition to the requirements in subsection (b), a ticket in a draw game must meet the following requirements:
(1) The ticket must have been issued by a terminal in an authorized transaction.
(2) The ticket must be printed on paper stock which was validly issued to and used by the terminal from whom the ticket was purchased at the time it was purchased.
(3) The information printed on the ticket must have been communicated to, accepted by, and recorded by the central computer, and the information on the ticket must correspond exactly with the commission's computer record.
(4) The information on the ticket must have been recorded in the central computer system prior to the play cutoff time for the selection event entered into the central computer as determined by the director or the director's designee, even if it appears that a play is accepted by virtue of the fact that the ticket was printed.
(5) The ticket serial number must be present in its entirety and be fully legible and must correspond in the records of the central computer to the game play information on the ticket.
(6) The ticket serial number of an apparent winning ticket must appear on the commission's official list of ticket serial numbers of winning tickets, and the ticket with that ticket serial number must not have been paid previously according to the records of the commission.
(7) Any display printing on the ticket stock must be regular in every respect and correspond exactly to the artwork on file with the commission for that game.

65 IAC 8-2-3 Ticket defects

Sec. 3. (a) If it is determined that a lottery ticket contains a manufacturing defect which makes validation of the ticket impossible, the ticket is void and the commission shall not be liable or responsible for the award of any prize thereon.

(b) When presented with a defective ticket, the commission shall reimburse the purchase price of such ticket, in one (1) of the following manners:
(1) cash or a cash equivalent;
(2) replacement tickets from the same or a different game with the same price; or
(3) coupons good toward the purchase of replacement tickets that are equivalent to the purchase price.

65 IAC 8-2-4 Disputes

Sec. 4. (a) If a person claiming a prize in a draw or scratch-off game is unable to produce the alleged winning ticket, the commission shall not pay the claimed prize unless the person presents terminal-generated proof or other evidence sufficient to establish the validity of a claim in a draw or scratch-off game.

(b) If a person claiming a prize in a pull-tab game is unable to produce the alleged winning pull-tab ticket, the commission shall not pay the claimed prize.

(c) Any person making a claim under subsection (a) may submit an affidavit to the director setting forth all facts, witnesses, and supporting information surrounding the person's claim. The director may authorize that the prize be paid to the claimant if satisfied that the validity of the claim has been established. If any prize claimed under this section exceeds five thousand dollars ($5,000), a determination by the director to pay the prize must be reviewed and authorized by the commission.

Rule 3. Prize Claims

Sec. 1. (a) Any prize may be redeemed at commission headquarters in Indianapolis, Indiana.

(b) The director may designate additional ticket redemption locations within the state of Indiana or accept redemptions by mail.

(c) The redemption of prizes by mail or at locations designated under subsection (b) may be limited based on prize level, product type, available security personnel, or any other reasonable consideration as determined by the director.

(d) A person who mails a winning ticket shall bear the risk that the U.S. Postal Service or other carrier may fail to timely postmark or deliver the ticket to the commission.

65 IAC 8-3-3 Prize claimants

Sec. 3. (a) A prize claimant may include:
(1) an individual;
(2) a legal business association;
(3) a trust; or
(4) a representative of an informal group, such as a family, club, or other organization which is not a legal entity.

(b) If prize claimant is a representative of a group under (a) (4) of this section [subsection (a)(4)], then the prize claimant shall file with its claim an Internal Revenue Service Form 5754, "Statement by Person(s) Receiving Gambling Winnings", or a successor form, with the commission designating to whom the prize is to be paid and the individual or individuals to whom the prize is taxable.

65 IAC 8-3-4 Form of claim

Sec. 4. (a) A prize claim shall be made on such form or forms as are prescribed by the director.

(b) A prize claimant shall provide the commission with the following:
(1) The ticket upon which the claim is being made.
(2) The name, address, telephone number (if any), and a copy of a government issued photo identification, such as a driver's license or passport, for the following:
(A) the prize claimant;
(B) the ticket purchaser, if known; and
(C) any prize winner.
(3) For prize claims that exceed five hundred ninety-nine dollars ($599), the Social Security number or other tax identification number of:
(A) the prize claimant; and
(B) any prize winner.

(c) Upon request, a prize claimant shall disclose to the commission, to the best of claimant's knowledge, where the ticket was purchased, the date purchased, and any other information necessary to establish the validity of the claim.

65 IAC 8-3-5 Outstanding debts for certain obligations

Sec. 5. (a) The following definitions apply to this section:
(1) "Claimant agency" means an entity which is required under IC 4-30-11-11(a) to identify to the commission persons who owe certain specified debts.
(2) "Debtor" means a person who has been reported to the commission pursuant to IC 4-30-11-11(a) as owing a debt specified therein.
(3) "Debt" means an obligation that is evidenced by an assessment or lien issued by a state agency, a judgment, or a final order of an administrative agency.

(b) A claimant agency may provide to the commission, in such computer-readable format as the director shall prescribe with the approval of the auditor of state, a list of debtors.

(c) Prior to payment of any net of wager cash prize greater than five hundred ninety-nine dollars ($599) to a prize claimant, the director or the director's designee shall determine whether the name of the prospective payee or prize winner appears on a list provided by a claimant agency pursuant to subsection (b). If the name of the prospective payee or prize winner appears on a list provided by a claimant agency pursuant to subsection (b), the amount of the cash prize payable to such debtor shall instead be paid to the auditor of state pursuant to IC 4-30-11-11(b). The commission shall pay the balance of the prize money to the prize winner after deduction of the obligations.

(d) Payment of a prize or portion of the prize to the auditor of state pursuant to this section shall discharge the commission, the director, and all employees of the commission from any liability to the debtor for payment of such prize or portion of the prize. The commission shall have no liability for any error on a list provided to the commission by a claimant agency pursuant to subsection (b).

Rule 4. Prize Payment


65 IAC 8-4-1 Type of payment

Sec. 1. (a) Prize payment shall be made to the prize winners identified on the claim form and associated documents, and the claim shall be final and binding on the claimant, prize winners, and any other persons for whom the prize is claimed.

(b) The commission may pay prizes with:
(1) a check;
(2) cash;
(3) an electronic transfer; or
(4) lottery tickets, if the prize claimant agrees.

(c) A person who submits by mail a lottery ticket that entitles the claimant to a prize of a "ticket" or "free ticket" and whose mailing address is outside the state of Indiana will receive a check in the amount of the retail sales price of the ticket in lieu of an actual ticket.

65 IAC 8-4-2 Annuity prizes; time of payment

Sec. 2. (a) Any prize of five hundred thousand dollars ($500,000) or more may be paid as an annuity over a period of time. If a prize is to be paid as an annuity prize, the director or the director's designee shall adopt rules that:
(1) designate the prize as an annuity prize; and
(2) establish the period of time over which payments will be made.

(b) When a prize or share of a prize is to be paid over time, the director or the director's designee may round the actual amount of the prize or share to the nearest one thousand dollars ($1,000) to facilitate purchase of an appropriate funding mechanism.

(c) Unless the rule for any specific game provides otherwise, the prize claimant of an annuity prize may elect to receive the prize in a single lump sum payment, which will be equal to the amount required to fund the annuity prize payments. The prize claimant must select the payment option for distribution of the prize amount within sixty (60) days from the day the prize claimant becomes entitled to receive the prize. The election of the prize claimant shall apply to all prize winners of that prize.

(d) If a prize claimant fails to select a payment option under subsection (b), the prize amount shall be paid out in a single lump sum payment pursuant to subsection (b)(2).

(e) The director may accelerate the payment of a prize when the acceleration is determined to be in the best interest of the commission. The valuation of any securities involved and the determination of the present value of any accelerated payments are solely within the discretion of the director or the director's designee.

65 IAC 8-4-3 Delay of payment

Sec. 3. (a) The director or the commission may delay making payment of any prize or installment of a prize pending a final determination by the director, by the commission, or by a court of competent jurisdiction under any of the following circumstances:
(1) A dispute occurs or it appears that a dispute may occur relative to any prize.
(2) There is any question regarding the identity of the claimant.
(3) There is any question regarding the validity of any ticket presented for payment.
(4) The claim is subject to any set off for debts pursuant to section 9 [sic] of this rule.
(5) The commission or the director becomes aware of a change in circumstance relative to a prize awarded, the payee, or the claim which the commission determines requires review.

(b) No liability or interest for any delay in payment of a prize or installment of a prize shall accrue to the benefit of the claimant or prize winner pending payment of the claim.

(c) All delayed payments for a prize paid in installments shall be brought up to date immediately upon the director's determination that payment of installments of a prize should be resumed, and remaining installment payments shall be paid according to the original payment schedule after payment is resumed unless the director orders otherwise.

65 IAC 8-4-4 Assignment of prizes

Sec. 4. (a) The director or the director's designee may pay any prize to the estate of a deceased prize winner upon presentation of sufficient evidence of the death of the prize winner as determined by the director or the director's designee.

(b) A prize or a portion of a prize may be assigned to another person under IC 4-30-11-2 pursuant to an appropriate judicial or administrative order entered in separate proceedings where assignment of the prize or a portion of the prize is ordered as an appropriate remedy in one (1) or more of the following circumstances:
(1) The order resolves an issue regarding the proper claimant or claimants for a prize.
(2) The order directs the payment of prize winnings to a former spouse as part of an equitable distribution or spousal support in a marital dissolution case.
(3) The order satisfies a child support obligation or arrearage.
(4) The order is for a garnishment allowing a debtor to satisfy a judgment.
(5) The director or the director's designee determines that the order is reasonably within the same class of orders listed in clause [subdivisions] (1) through (4).

(c) An appropriate order does not include an order requested for the convenience of the prize claimant or as part of a factoring transaction or other voluntary debt incurred in exchange for an assignment of future prize payments.

65 IAC 8-4-5 Commission decisions final; escrow

Sec. 5. (a) The decision and judgment of the commission regarding the validation of any ticket or of any dispute arising from payment of a prize shall be final and binding upon all participants unless otherwise provided by law or article.

(b) If a question arises relative to a winning lottery ticket or the payment of any prize, the commission may deposit the prize winnings into an escrow fund until it resolves the controversy and reached a decision.
