PURPOSE OF NOTICE
The Indiana Department of Environmental Management (IDEM) has developed draft rule language for amendments to 326 IAC 1-1-3 concerning an update to References to the Code of Federal Regulations (CFR) to mean the 2006 edition. This rulemaking includes other amendments throughout Title 326 that would remove citations to the Federal Register that are redundant as a result of the update to the references to the Code of Federal Regulations. IDEM has scheduled a public hearing before the Air Pollution Control Board (board) prior to consideration for preliminary adoption of amendments to these rules.

STATUTORY REQUIREMENTS
IC 13-14-9-8 recognizes that under certain circumstances it may be appropriate to reduce the number of public comment periods routinely provided. In cases where the commissioner determines that there is no anticipated benefit from the first and second public comment periods, IDEM may forgo these comment periods and proceed directly to the public hearing and board meeting at which the draft rule is considered for preliminary adoption. Two opportunities for public comment (at the public hearings prior to preliminary and final adoption of the rule) remain under this procedure.
If the commissioner makes the determination of no anticipated benefit required by IC 13-14-9-8, the commissioner shall prepare written findings and publish those findings in the Indiana Register prior to the board meeting at which the draft rule is to be considered for preliminary adoption, and include them in the board packet prepared for that meeting. This document constitutes the commissioner's written findings pursuant to IC 13-14-9-8.
The statute provides for this shortened rulemaking process if the commissioner determines that:
(1) the rule constitutes:
(A) an adoption or incorporation by reference of a federal law, regulation, or rule that:
(i) is or will be applicable to Indiana; and
(ii) contains no amendments that have a substantive effect on the scope or intended application of the federal law or rule;
(B) a technical amendment with no substantive effect on an existing Indiana rule; or
(C) a substantive amendment to an existing Indiana rule, the primary and intended purpose of which is to clarify the existing rule; and
(2) the rule is of such nature and scope that there is no reasonably anticipated benefit to the environment or the persons referred to in IC 13-14-9-7(a)(2) from:
(A) exposing the rule to diverse public comment under section IC 13-14-9-3 or IC 13-14-9-4;
(B) affording interested or affected parties the opportunity to be heard under IC 13-14-9-3 or IC 13-14-9-4; and
(C) affording interested or affected parties the opportunity to develop evidence in the record collected under IC 13-14-9-3 and IC 13-14-9-4.

BACKGROUND
326 IAC 1-1-3, References to the Code of Federal Regulations (CFR), indicates the yearly edition of the CFR that is applicable to rules that have been incorporated by reference throughout Title 326 of the Indiana Administrative Code (IAC), unless a different edition is specified in a given rule. By annually updating the reference to the CFR, IDEM is able to incorporate by reference the latest version of the parts of the CFR already incorporated into the air rules, with the exception of those most recently published in the Federal Register (FR).
The 2006 edition of the CFR is a codification of the general and permanent rules published in the FR as of June 30, 2006. IDEM incorporates citations by reference from Titles 29 and 40 of the CFR.
Title 29 of the CFR, entitled "Intergovernmental Review of Environmental Protection Agency Programs and Activities" contains federal rules for the asbestos and lead programs. Title 29 of the CFR is referenced in 326 IAC 14 (Emission Standards for Hazardous Air Pollutants), 326 IAC 20 (Asbestos Management), and 326 IAC 23 (Lead-Based Paint Program). Many of these regulations are either directly incorporated by reference into Title 326 of the IAC as state-enforceable rule provisions or they are incorporated into Title 326 of the IAC as federal authority for the implementation and enforcement of state rule provisions.
Title 40 of the CFR entitled "Protection of Environment," includes all federal environmental regulations promulgated by the U.S. Environmental Protection Agency (U.S. EPA). It is referenced throughout Title 326 of the IAC.
The latest version of the CFR adopted by the Air Pollution Control Board is dated July 1, 2005. Since that date, a number of new federal rules have been promulgated that were incorporated by reference into state rules using their FR citation; these FR citations are now redundant and will therefore be deleted.
The types of changes proposed in this rulemaking are: (1) Incorporating by reference the latest version of the CFR by updating the reference to the CFR at 1-1-3; and (2) deleting redundant FR citations.
The following is a nonexhaustive list of examples of rules and changes that occurred between July 1, 2005, and June 30, 2006, that will be automatically updated with the update to the CFR definition:
  • On July 11, 2005, U.S. EPA in a final rule amended Table 1 of Subpart B of Part 63 to reflect the revised deadlines in a recently amended consent decree. The final rule amendment (and amended consent decree) relates to boilers and hydrochloric acid production furnaces that burn hazardous waste. 70 FR 39664; July 11, 2005. Citation Affected: 326 IAC 2-4.1-1.
  • On November 13, 2003, U.S. EPA promulgated national emission standards for hazardous air pollutants (NESHAP) for surface coating of metal cans (68 FR 64432). The final rule (40 CFR Part 63, Subpart KKKK) includes standards for hazardous air pollutants (HAP), as well as monitoring, performance testing, record keeping, and reporting requirements related to the standards. After promulgation of the final rule, U.S. EPA received numerous questions related to the rule interpretation. The questions pointed out minor inconsistencies in some of the rule language and equations and identified areas where the rule requirements were not clear. On January 6, 2006, U.S. EPA took direct final action on amendments to resolve inconsistencies and clarify rule language. 71 FR 1384; January 6, 2006. Citation Affected: 326 IAC 20-86-1.
  • On April 16, 2003, U.S. EPA promulgated the NESHAP for new and existing refractory products manufacturing facilities as 40 CFR Part 63, Subpart SSSSS. Shortly after U.S. EPA also promulgated amendments to the general provisions to 40 CFR Part 63. U.S. EPA then identified minor technical errors and other specific sections of the refractory products manufacturing NESHAP that needed clarification. These amendments to the refractory products manufacturing NESHAP clarify the requirements for testing, control device operation, operating limits, and monitoring. 71 FR 7423-7440; February 13, 2006. Citation Affected: 326 IAC 20-62-1.
  • U.S. EPA promulgated the NESHAP for miscellaneous organic chemical manufacturing on November 10, 2003 (40 CFR Part 63, Subpart FFFF). The direct final rule amendments include several changes to correct references and drafting errors. The introductory text in 40 CFR 63.9(h)(2)(I) requires the owner or operator of an affected source to submit to the Administrator a notification of compliance status, signed by the responsible official who shall certify its accuracy. Table 12 Subpart FFFF of Part 63 inadvertently stated that this paragraph does not apply to Subpart FFFF. This was not the U.S. EPA's intent. Only (A) through (G) do not apply because the types of information to include in the report are specified in 63.2520(d) of Subpart FFFF rather than 63.9(h)(2). 70 FR 51269; August 30, 2005.   • U.S. EPA took direct final rule action on amendments to the NESHAP for cellulose products manufacturing, which were issued on June 11, 2002, under Section 112 of the Clean Air Act. The amendments revise the work practice standards, general and initial compliance requirements, definitions, and general provisions applicability, as well as correct typographical, formatting, and cross-referencing errors in the final rule. 70 FR 46694-46699; August 10, 2005. Citation Affected: 326 IAC 20-54-1.
  • U.S. EPA promulgated the NESHAP for reinforced plastic composites production on April 21, 2003. The final rule (40 CFR Part 63, Subpart WWWW) includes standards for hazardous air pollutants, as well as monitoring, performance testing, recordkeeping, and reporting requirements related to those standards. The U.S. EPA received questions regarding rule interpretation about some of the tables and rule language. None of the amendments will have any discernable effect on the stringency of the rule. 70 FR 50129-50135; August 25, 2005. Citation Affected: 326 IAC 20-56-1.
  • 40 CFR 52.2 states that a major source that is major for VOCs or NOx shall be considered major for ozone. Any significant emissions increase from any emissions units or net emissions increase at a major stationary source that is significant for VOCs or NOx shall be considered significant for ozone. Any pollutant for which a national ambient air quality standard has been promulgated and any constituents or precursors for such pollutants identified by the Administrator are precursors for ozone. 70 FR 71704; November 29, 2005.   • The following are amendments to NESHAPs that have been finalized between July 1, 2005, and June 30, 2006, under Section 112(f) of the Clean Air Act (the Residual Risk Program) to add health based emission requirements or a Section 112(d)(6) technology review:
  • 1) April 7, 2006 (71 FR 17720) Magnetic Tape Manufacturing. 40 CFR Subpart EE, incorporated by reference at 326 IAC 20-9. No substantial amendments were made to 40 CFR Subpart EE due to residual risk or Section 112(d)(6) technology review.
    2) April 7, 2006 (71 FR 17729) Industrial Process Cooling Towers. 40 CFR Subpart Q, incorporated by reference at 326 IAC 20-4. Residual risk rule amends applicability section to clarify that chromium based water treatment chemicals are subject to the rule; no new requirements due to residual risk.
    3) April 6, 2006 (71 FR 17362) Gasoline Distribution Facilities. 40 CFR Subpart R, incorporated by reference at 326 IAC 20-10. No amendments due to residual risk or Section 112(d)(6) technology review; amends a reference error.
  • May 10, 2006 (71 FR 27332) Standards of performance for new stationary sources and emission guidelines for existing sources: large municipal waste combustors. U.S. EPA promulgated standards for municipal waste combustors (MWC) units in 1995 and implemented them in 2000. The Clean Air Act (CAA) requires review of these standards every 5 years. The review is to be conducted in accordance with CAA Section 129 and Section 111 requirements, with standards revised as necessary. For existing MWC units, the goal of this action is to amend the standards to reflect the actual performance levels being achieved by existing MWC units. For new MWC units, the goal of this action is to amend the standards to reflect the performance level achievable by MWC units constructed in the future. Other technical improvements were made to the standards for MWC units. Amendments were made to 40 CFR 60 Subpart Cb and Subpart Eb. The update the CFR definition will only amend the compliance testing and operator training revisions for existing sources in 326 IAC 11-7 and new source performance standard provisions in 326 IAC 11-7. The emissions limits and compliance schedule for existing municipal waste combustors that are not incorporated by reference in 326 IAC 11-7 will be amended in a separate rulemaking.   • IC 13-14-9-4 Identification of Restrictions and Requirements Not Imposed under Federal Law
    No element of the draft rule imposes either a restriction or a requirement on persons to whom the draft rule applies that is not imposed under federal law. This draft rule imposes no restrictions or requirements because it is a direct adoption of federal requirements that are applicable to Indiana and contains no amendments that have a substantive effect on the scope or application of the federal rule.
    Potential Fiscal Impact
    Updating the reference to the Code of Federal Regulations to mean the July 1, 2006, edition allows federal and state rules to be consistent with each other and does not establish any requirements to which the regulated sources are not already subject. There are no increased costs to the regulated entities due to the state rulemaking.

    FINDINGS
    The commissioner of IDEM has prepared findings regarding rulemaking on the incorporation by reference of the 2006 version of the Code of Federal Regulations (CFR) as required by federal rule. These findings are prepared under IC 13-14-9-8 and are as follows:
    (1) This rule consists of the direct adoption of incorporation of federal requirements that are applicable to Indiana and it contains no amendments that have a substantive effect on the scope or intended application of the federal rule; and technical amendments with no substantive effect on existing Indiana rules.
    (2) Indiana, in many cases, is required by the CAA to adopt these requirements as state rules.
    (3) The public will benefit from the prompt adoption of this rule because it alleviates unnecessary duplication of rulemaking efforts by the state by directly updating the references to the Code of Federal Regulations (CFR) that have been amended by U.S. EPA.
    (4) I have determined that under the specific circumstances pertaining to this rule, there would be no benefit to the environment or to persons to be regulated or otherwise affected by this rule from the first and second public comment periods.
    (5) The draft rule is hereby incorporated into these findings.

    326 IAC 11-8-1 Applicability

    Sec. 1. (a) Except as provided in subsections (b) and (e) (f), and through (g), this rule applies to each commercial and industrial solid waste incineration (CISWI) unit as defined in 40 CFR 60.2875* 65 FR 75338 (December 1, 2000)*, for which construction was commenced on or before November 30, 1999.

    (b) The following are exempt from this rule:
    (1) Incineration units burning ninety percent (90%) or more by weight (on a calendar quarter basis and excluding the weight of auxiliary fuel and combustion air) of pathological waste, low-level radioactive waste, or chemotherapeutic waste, or any combination of these wastes as defined in 40 CFR 60.2875*, 65 FR 75338 (December 1, 2000)*, provided the owner or operator of the incinerator does all of the following:
    (A) Notifies the department and U.S. EPA that the unit meets the criteria in this subdivision.
    (B) Keeps records on a calendar quarter basis of the weight of pathological waste, low-level radioactive waste, or chemotherapeutic waste, or any combination of these wastes burned, and the weight of all other fuels and wastes burned in the unit.
    (2) Incineration units burning ninety percent (90%) or more by weight (on a calendar quarter basis and excluding the weight of auxiliary fuel and combustion air) of agricultural wastes as defined in 40 CFR 60.2875*, 65 FR 75338 (December 1, 2000)*, provided the owner or operator of the incinerator does all of the following:
    (A) Notifies the department and U.S. EPA that the unit meets the criteria in this subdivision.
    (B) Keeps records on a calendar quarter basis of the weight of agricultural waste burned, and the weight of all other fuels and wastes burned in the unit.
    (3) Incineration units that meet either of the following criteria:
    (A) Qualify as a municipal waste combustor regulated under 40 CFR 60, Subpart Cb*, Ea*, Eb*, AAAA*, (65 FR 76350 (December 6, 2000))* or BBBB*. (65 FR 76378 (December 6, 2000))*.
    (B) Burn greater than thirty percent (30%) municipal solid waste or refuse-derived fuel, as defined in 40 CFR 60, Subpart Ea*, Eb*, AAAA*, (65 FR 76350 (December 6, 2000))*, and BBBB*, (65 FR 76378 (December 6, 2000))*, and that have the capacity to burn less than thirty-five (35) tons per day of municipal solid waste or refuse-derived fuel, provided the owner or operator of the incinerator does all of the following:
    (i) Notifies the department and U.S. EPA that the unit meets the criteria in clause (A) or (B).
    (ii) Keeps records on a calendar quarter basis of the weight of municipal solid waste burned, and the weight of all other fuels and wastes burned in the unit.
    (4) Medical waste incineration units regulated under 40 CFR 60, Subpart Ca* or Ec*.
    (5) Small power production units that meet all of the following requirements:
    (A) The unit qualifies as a small power-production facility under Section 3(17)(C) of the Federal Power Act (16 U.S.C. 796(17)(C))*.
    (B) The unit burns homogeneous waste, not including refuse-derived fuel, to produce electricity.
    (C) The owner or operator notifies the department and U.S. EPA that the unit meets all of the requirements in clauses (A) and (B).
    (6) Cogeneration units that meet all of the following requirements:
    (A) The unit qualifies as a cogeneration facility under Section 3(18)(B) of the Federal Power Act (16 U.S.C. 796(18)(B))*.
    (B) The unit burns homogeneous waste, not including refuse-derived fuel, to produce electricity and steam or other forms of energy used for industrial, commercial, heating, or cooling purposes.
    (C) The owner or operator notifies the department and U.S. EPA that the unit meets all of the requirements in clauses (A) and (B).
    (7) Hazardous waste combustion units that meet either of the following criteria:
    (A) Any combustor required to have a permit under Section 3005 of the Solid Waste Disposal Act*.
    (B) Units regulated under 40 CFR 63, Subpart EEE*.
    (8) Materials recovery units that combust waste for the primary purpose of recovering metals, such as primary and secondary smelters.
    (9) Cyclonic barrel burners as defined in 40 CFR 60.2875*. 65 FR 75338 (December 1, 2000)*.
    (10) Rack, part, and drum reclamation units as defined in 40 CFR 60.2875*. 65 FR 75338 (December 1, 2000)*.
    (11) Cement kilns regulated under 40 CFR 63, Subpart LLL*.
    (12) Sewage sludge incinerators regulated under 40 CFR 60, Subpart O*.
    (13) Combustion units burning materials to recover chemical constituents or to produce chemical compounds where there is an existing commercial market for such recovered chemical constituents or compounds. The following types of units are considered chemical recovery units:
    (A) Units burning only pulping liquors that are:
    (i) reclaimed in a pulping liquor recovery process; and
    (ii) reused in the pulping process.
    (B) Units burning only spent sulfuric acid used to produce virgin sulfuric acid.
    (C) Units burning only wood or coal feedstock for the production of charcoal.
    (D) Units burning only manufacturing byproduct streams or residues containing catalyst metals which that are reclaimed and reused as catalysts or used to produce commercial grade catalysts.
    (E) Units burning only coke to produce purified carbon monoxide that is used as an intermediate in the production of other chemical compounds.
    (F) Units burning only hydrocarbon liquids or solids to produce:
    (i) hydrogen;
    (ii) carbon monoxide;
    (iii) synthesis gas; or
    (iv) other gases;
    for the use in other manufacturing processes.
    (G) Units burning only photographic film to recover silver.
    (14) Laboratory analysis units that burn samples of materials for the purpose of chemical or physical analysis.

    (c) The owner or operator of a unit listed in subsection (b) must submit an exemption notification no not later than one (1) year from the effective date of this rule.

    (d) Pathological waste exemptions submitted under 326 IAC 11-6 satisfy the conditions of subsection (b)(1).

    (e) Air curtain incinerators or destructors that only burn one (1) of the following fuels are required to comply with only 40 CFR 60.2810 through 40 CFR 60.2870* 65 FR 75338 (December 1, 2000)* and obtain approval under 326 IAC 4-1-6:
    (1) One hundred percent (100%) wood waste.
    (2) One hundred percent (100%) clean lumber.
    (3) One hundred percent (100%) mixture of only wood waste, clean lumber, yard waste, or any combination of these wastes.

    (f) If the owner or operator of a CISWI unit makes changes that meet the definition of modification or reconstruction, as defined in 40 CFR 60.2875*, on or after June 1, 2001:
    (1) the CISWI unit becomes subject to 40 CFR 60, Subpart CCCC* 65 FR 75338 (December 1, 2000)* and 326 IAC 12; and
    (2) this rule no longer applies to that CISWI unit.

    (g) Physical or operational changes made to an existing CISWI unit primarily to comply with emission limits under this rule:
    (1) are not considered modifications or reconstructions; and

    (1) submits a final control plan no not later than one (1) year from the effective date of this rule; or
    (2) requests and is granted an extension of the closure date pursuant to under subsection (e).

    (d) If the owner or operator submits a final control plan, the compliance dates for the increments of progress in 40 CFR 60, Subpart DDDD, Table 1* 65 FR 75338 (December 1, 2000)* are as follows:
    (1) The compliance date for Increment 1–Submit Final Control Plan shall be one (1) year from the effective date of this rule.
    (2) The compliance date for Increment 2– Final Compliance shall be September 1, 2005.

    (e) An owner or operator may request an extension of the closure date to achieve compliance as expeditiously as possible, but no not later than September 1, 2005, by submitting a closure notification pursuant to 40 CFR 60.2615* and 40 CFR 60.2855* 65 FR 75338 (December 1, 2000)*, as follows:
    (1) The request for extension shall include all of the following supporting documentation:
    (A) Analysis that supports the need for the requested extension.
    (B) Explanation of why a closure date of one (1) year after the effective date does not provide sufficient time to shut down.
    (C) Explanation of why the requested closure date provides sufficient time to shut down.
    (2) The request for extension shall be submitted to the department within eight (8) months from the effective date of this rule, and the department shall grant or deny the extension in a written response to the owner or operator within three (3) months of receipt of a closure notification that contains all required information.
    (3) An owner or operator shutting down the incinerator shall submit a waste management plan, as defined in 40 CFR 60.2620 through 40 CFR 60.2630, no not later than one (1) year after the effective date of this rule.
