  • Title 312 Natural Resources Commission -- #00-40 (PDF)

    Adds 312 IAC 16-1-19.5, 312 IAC 16-1-21.5, 312 IAC 16-1-28.5, 312 IAC 16-1-31.5, 312 IAC 16-1-43.5, 312 IAC 16-1-43.7, 312 IAC 16-1-44.5, 312 IAC 16-1-45.5, and 312 IAC 16-1-50.5 to establish new definitions for oil and gas operations. Adds 312 IAC 16-5-22, 312 IAC 16-5-23, 312 IAC 16-5-24, 312 IAC 16-5-25, 312 IAC 16-5-26, 312 IAC 16-5-27, 312 IAC 16-5-28, and 312 IAC 16-5-29 and attendant definitions to allow the department of natural resources, division of oil and gas, to manage the reporting, containment, and cleanup of spills of oil and saltwater. Specifies the reporting criteria, containment requirements, and cleanup standards that will be applied to spills of oil or saltwater from oil and gas operations at a facility defined by the rule.

    Adds 327 IAC 5-16, 327 IAC 5-17, 327 IAC 5-18, 327 IAC 5-19, 327 IAC 5-20, and 327 IAC 5-21 concerning industrial wastewater pretreatment in order to comply with the federal regulations and to acquire federal delegation of the state's pretreatment program. Repeals 327 IAC 5-11, 327 IAC 5-12, 327 IAC 5-13, 327 IAC 5-14, and 327 IAC 5-15.

    Amends 327 IAC 5-2-11.7 concerning Great Lakes system dischargers interim antidegradation implementation procedures for outstanding state resource waters.

  • Title 329 Solid Waste Management Board -- #98-96 (PDF)

    Adds 329 IAC 15 to establish requirements for management of waste tires, including requirements adopted in Public Law 93-1998. Repeals 329 IAC 12-5 and 329 IAC 12-6. Note: Under IC 4-22-2-40, LSA Document #98-96, printed at 22 IR 3137, was recalled by the Solid Waste Management Board. This document was revised and readopted.

  • Title 410 Indiana State Department of Health -- #99-151 (PDF)

    Adds 410 IAC 1-2.3 to define and classify communicable diseases and other diseases that are a danger to health based upon the characteristics of the disease, and to establish reporting, monitoring, and preventive procedures for communicable diseases. Repeals 410 IAC 1-2.1.

  • Title 440 Division of Mental Health -- #99-268 (PDF)

    Adds 440 IAC 8 to describe the categories of individuals served by managed care providers of services funded by the division of mental health and by community mental health centers certified by the division of mental health. Adds 440 IAC 9 to establish standards and requirements for community mental health centers and certified managed care providers regarding 24 hour crisis intervention services and individualized treatment planning to increase patient coping skills and symptom management as part of the required continuum of care for persons needing addiction services, persons with serious mental illness, or children with serious emotional disorders.

    Amends 540 IAC 1-4-3 to update language as a result of the repeal of 540 IAC 1-8-3. Amends 540 IAC 1-8-4 to clarify the maximum aggregate of all account balances in favor of a single program beneficiary. Amends 540 IAC 1-8-5 to update language as a result of the repeal of 540 IAC 1-8-3. Adds 540 IAC 1-10-1.5 to require annual certifications by program beneficiaries that distributions were utilized for qualified educational expenses. Adds 540 IAC 1-10-1.6 regarding withholding provisions to cover potential penalties for nonqualified distributions. Repeals 540 IAC 1-8-3.
