  • Title 312 Natural Resources Commission -- #01-282 (PDF)

    Adds 312 IAC 5-9-4, concerning rules that govern the operation of watercraft on public waters in Indiana, to establish restrictions on Prairie Creek Reservoir in Delaware County. A speed limit of 20 miles per hour would be established for all watercraft. Motorboats would be prohibited from towing water skis and similar objects north of a line extending westerly from the bridge over Huffman Creek on County Road 560 East (also known as Gates Road).

  • Title 329 Solid Waste Management Board -- #01-289 (PDF)

    Amends 329 IAC 3.1-1-7 to achieve consistency with federal hazardous waste management regulations by incorporating by reference changes to the federal hazardous waste management regulations at 40 CFR 260 through 40 CFR 270, published in the Federal Register from July 10, 2000, through May 16, 2001. Amends 329 IAC 3.1-7-2 to be consistent with IC 13-22-4-3.1 by removing a provision that requires generators to enter waste handling codes on the Uniform Hazardous Waste Manifest. Amends 329 IAC 3.1-9-2 and 329 IAC 3.1-10-2 to be consistent with Public Law 143-2000 by removing provisions that require permitted treatment, storage, and disposal facilities to send copies of hazardous waste manifests to IDEM. Repeals 329 IAC 3.1-4-9.1 and 329 IAC 3.1-4-17.1.

    Amends 405 IAC 1-12 to establish Medicaid reimbursement criteria for certain community residential facilities for the developmentally disabled (CRFs/DD) licensed as small extensive medical needs residence for adults. Sets a limit of 12 hours per resident day for staffing costs for a facility that is exclusively for adults with extensive medical needs.

    Amends 405 IAC 5-34 to specify documentation requirements under the Medicaid hospice benefit for individuals enrolled in the Medicaid hospice benefit, and to provide for retrospective audit of hospice services, including review for medical necessity. Amends 405 IAC 5-34-1 to specify that the hospice provider must provide all services in compliance with the Medicaid provider agreement, the appropriate provider manual and all other Medicaid policy documents issued to provider at the time services were rendered, and any applicable state or federal statute or regulations. Amends 405 IAC 5-34-3 to allow Medicaid reimbursement for hospice services provided by out of state hospice providers outside of designated areas if certain conditions are met.     Amends 511 IAC 6.1-5.1-5 to remove from the approved list of high school mathematics courses those courses that are remedial in nature or duplicate other courses. Adds a remedial mathematics course that will not count toward the high school graduation requirement in mathematics. Consolidates certain courses to more accurately reflect the manner in which the courses should be offered. Changes the names of courses to reflect the academic standards on which the courses are based. Effective July 1, 2004. Statutory authority: IC 20-1-1.2-18.

  • Title 825 Indiana Grain Indemnity Corporation -- #02-179 (PDF)

    Repeals 825 IAC 1-1-5, "Grain" defined, in order to eliminate redundancy between the rule and in the definition that currently exists in IC 26-4-1-13. Repeals 825 IAC 1-5-1 and 825 IAC 1-5-2 in order to remove language relating to new producers that was removed from IC 26-4-1-16 during the 2001 Session of the General Assembly.
