    Adds 312 IAC 21 to provide standards for archaeological review and recovery. Incorporates statutory changes made to the enabling legislation made since the adoption of 310 IAC 19. Requires a principal investigator to be qualified by training and experience to coordinate, develop, and complete an archaeological project. Requires a field or laboratory supervisor to be qualified by training and experience to perform these supervisory functions. Clarifies ethical standards. Repeals 310 IAC 19.

    Adopts and amends the International Residential Code (IRC) for One and Two Family Dwellings as 675 IAC 14-4.2. Amends 675 IAC 17-1.5-11.5 of the 1999 Indiana Electrical Code so as to not be in conflict with the electrical provisions of the Indiana Residential Code. Repeals 675 IAC 14-4.1.

  • Title 310 Department of Natural Resources -- #01-211 (PDF)

    Temporarily modifies 310 IAC 2.1-6-12 that governs the operation of watercraft on the Tippecanoe River in White County and Carroll County, including Lake Shafer and Lake Freeman. Zones where the operation of watercraft is restricted are established in two areas, both of which will be marked with uniform Indiana markers and buoys. (1) A ten mile per hour speed limit is established on the portion of Lake Shafer where dredging operations are scheduled to take place in the summer of 2001. The affected area extends from the Sandbar Restaurant to 7,200 feet south (downstream). (2) A no-boat zone is established within 1,000 feet of either side of the U.S. 421 bridge over the Tippecanoe River (Lake Freeman) during bridge construction. This restriction allows for the designation of buoys of an idle speed zone to allow watercraft to pass through the no-boat zone. The restriction also allows for access to piers and docks located within the no-boat zone.

    -- To adopt plan loan procedures for making loans to participants from the legislators' defined contribution plan as required by HEA 1193, as passed during the first regular session of the 112th Indiana general assembly. The rule would establish maximum loan amounts, maximum loan duration, and other procedural requirements for receiving a loan pursuant to Section 72(p) of the Internal Revenue Code.   • Title 50 State Board of Tax Commissioners -- #01-226 (PDF)

    -- Public Law 198-2001 (HEA 1499) contains several provisions that affect rules previously promulgated by the State Board of Tax Commissioners. The provisions of Public Law 198-2001 supercede, directly and indirectly, some portions of existing Board rules. Certain new provisions of Public Law 198-2001 expressly prohibit the Board from promulgating rules regarding matters that are the subject of existing Board rules. Other provisions of Public Law 198-2001 are inconsistent with portions of certain existing rules and, consequently, will govern to effectively override those portions of the rules. These situations dictate the need for the Board to amend portions of those rules that have been either superceded by Public Law 198-2001, or are otherwise inconsistent with Public Law 198-2001. The Board intends to adopt rules to amend provisions of existing rules that are impacted by Public Law 198-2001, by removing the portions of those rules that are now prohibited by Public Law 198-2001, making the rules completely consistent with, and in conformance with, the requirements of Public Law 198-2001. The Board also intends to revise, edit, delete, add, or otherwise amend the existing rules, as it may deem desirable in order to make them compliant with provisions of Public Law 198-2001. Although the Board is still in the process of identifying all rules that may be affected by Public Law 198-2001, it has determined that amendments will be required to 50 IAC 12 (concerning computer standards); 50 IAC 13 (concerning land valuation); 50 IAC 15 (concerning assessor-appraisers, professional appraisers, and tax representatives); 50 IAC 16 (concerning amended personal property returns); and 50 IAC 17 (concerning procedural rules). The State Board of Tax Commissioners invites written suggestions, facts, arguments, or views in these matters.     -- Amends 405 IAC 2-3-1.1 to specify the method for calculating the Medicaid eligibility penalty for transferring income. Specifies that when the right to a stream of income is transferred for less than fair market value, the penalty is calculated based on the projected total income expected to be transferred during the individual's lifetime. Specifies that a transfer of income includes, but is not limited to (1) transferring income-producing real property; and (2) accepting less than the fair market rental value when property is rented. Specifies that, for purposes of the Medicaid eligibility penalty for transferring assets for less than fair market value, 'assets' includes any income or resources which the applicant or recipient or the applicant's or recipient's spouse is entitled to receive, but does not receive because of failure to take action to receive those assets.     Amends 312 IAC 13-4-1 and 312 IAC 13-6-2 that governs water well drillers (and the construction, maintenance, and proper abandonment of water wells) to authorize the use of corrugated fiberglass casing in bucket wells. Establishes minimum technical standards for the use of corrugated fiberglass casing.

    Adds 326 IAC 1-2-82.5 to define 'Title I conditions'. Amends 326 IAC 2 concerning amendments necessary to obtain U. S.   • Title 329 Solid Waste Management Board -- #01-207 (PDF)

    Amends and considers for readoption pursuant to comments received under IC 13-14-9.5, 329 IAC 11-9, 329 IAC 11-11, and 329 IAC 11-14. 329 IAC 11-9 addresses solid waste processing facilities permit requirements; 329 IAC 11-11 addresses solid waste processing permit issuance; and 329 IAC 11-14 addresses quarterly reporting of solid waste processing facilities. The amendments correct language and references. This rulemaking is required pursuant to IC 13-14-9.5, which provides for the expiration and readoption of administrative rules. A rule that was adopted under a provision of IC 13 and was in effect on December 31, 1995, expires not later than January 1, 2002. All rules adopted after that date under IC 13-14-9, with some exceptions listed in IC 13-14-9.5-1 and IC 13-14-9.5-1.1, expire on January 1 of the seventh year after the year in which each rule takes effect. The First Notice of Comment Period and Continuation of First Notice of Comment Period opened all rules required to be opened in Title 329 for readoption, regardless of their initial effective date. Other comments received are being included and considered within other currently existing rulemakings.

    Amends 405 IAC 1-14.6-2, 405 IAC 1-14.6-3, 405 IAC 1-14.6-4, 405 IAC 1-14.6-5, 405 IAC 1-14.6-6, 405 IAC 1-14.6-7, 405 IAC 1-14.6-9, and 405 IAC 1-14.6-20 to revise case mix reimbursement methodology by modifying the payment methodology for therapy, for repairs and maintenance costs, reduce the profit-add-on percentage, and update case mix indices. Amends 405 IAC 1-15-5 and 405 IAC 1-15-6 to clarify when MDS assessments are due at the conclusion of therapies and to make technical changes.

    -- The Indiana Department of Environmental Management (IDEM) has developed draft rule language for amendments to 326 IAC 1-1-3, concerning references to the Code of Federal Regulations (CFR), to update any references to the CFR in Title 326 to mean the July 1, 2000, edition. IDEM has also developed draft rule language for amendments to Title 326 to change any incorporation by reference of the Federal Register (FR) to its CFR citation published in the July 1, 2000 edition of the CFR. The Indiana Department of Environmental Management (IDEM) has developed draft language for new rules 326 IAC 1-1-3.5 and 326 IAC 1-2-20.5, establishing references to and definition of the Compilation of Air Pollution Emission Factors AP-42 and Supplements. IDEM has scheduled a public hearing before the air pollution control board for consideration of preliminary adoption of these rules.
