    Temporarily amends 312 IAC 9 to govern noncommercial hunts at Big Walnut Nature Preserve and Twin Swamps Nature Preserve. Under IC 4-22-2-37.1, IC 14-10-2-5, and IC 14-22-2-6, the director of the department of natural resources adopts the emergency rule set forth in this document. The emergency rule is adopted with the awareness the regulation of wild animals in Indiana is the responsibility of the department of natural resources, and with a heightened awareness of that responsibility (as well as a responsibility for the welfare of flora and other fauna), within dedicated nature preserves. Based upon the opinion of professional biologists, the director has determined: (A) white-tailed deer within these nature preserves have caused, and will continue to cause, obvious and measurable damage to the ecological balance within these preserves; and (B) the ecological balance within the nature preserves will not be maintained unless action is taken to control their populations. Examples of damages caused by excessive deer populations include reduction of rare plant species and sampling data that show, more generally, vegetation species disturbance in areas accessible to deer browsing.

  • Title 460 Division of Disability and Rehabilitative Services -- #00-286 (PDF)

    -- Adds 460 IAC 1-3.6 to create criteria for financial and medical eligibility for the room and board assistance (RBA) and assistance to residents in county homes (ARCH) programs. This rule will combine, clarify, simplify, and replace current rules found in 460 IAC 1-3 and 470 IAC 8.1-2, which refer to the RBA and ARCH programs, respectively, and which will be allowed to expire. This rule will create internally consistent standards for the RBA and ARCH programs, and will be consistent with Indiana and federal statutes. This rule will put the ARCH program into Title 460, under the division of disability, aging, and rehabilitative services, which already administers the program.   • Title 327 Water Pollution Control Board -- #00-111 (PDF)

    Amends 327 IAC 8-2 concerning amendments to 327 IAC 8-2 concerning lead and copper. On January 12, 2000, U.S. EPA published national primary drinking water regulations for lead and copper. These regulations make changes to the lead and copper rule as published June 7, 1991. These minor revisions are being made to improve implementation of the rule. The intended effect of the rule is to eliminate unnecessary requirements, streamline and reduce reporting burden, and promote consistent national implementation of the federal rule. Indiana is required to adopt these revisions in order to maintain primacy (primary enforcement authority) for the lead and copper rule.

    -- The Indiana Department of Environmental of Management (IDEM) solicited public comment on the readoption of the following rules in Title 326 of the Indiana Administrative Code pursuant to IC 13-14-9.5 in second notice of comment period #00-44(APCB) that published in the October 1, 2000, Indiana Register (24 IR 132). A response to a comment received in response to the first notice of comment period #00-44 concerning 326 IAC 18-2 was inadvertently omitted in the second notice of comment period #00-44(APCB). Comments received in response to the second notice of comment period published on October 1, 2000, do not need to be resubmitted. The rules are being published as they were most recently adopted by the board. IDEM seeks comment on the rule language, including any specific revisions to the rule language.

    -- The Indiana Department of Environmental Management (IDEM) is soliciting public comment on amendments to rules at 329 IAC 7 concerning the Indiana Scoring Model and the assessment of hazardous substance response sites. This rule will reconsider the maximum score to allow sites to be deleted from the Commissioner's Bulletin. This rule will also consider appropriate criteria or designation for the deletion of sites from the Commissioner's Bulletin as an alternative to using the maximum score for deleting a site. IDEM seeks comments on the affected citations listed and any other provision of Title 329 that may be affected by this rulemaking.
