  • Title 312 Natural Resources Commission -- #01-91 (PDF)

    Adds 312 IAC 23-3-5 to authorize modification of a previously approved certification of the Indiana state historic rehabilitation tax credit. The division of historic preservation and archaeology may seek a modification based upon an allegation of misrepresentation, fraud, or similar good cause through a complaint filed with the natural resources commission. The division may modify the credit, if caused by a statutory change subsequent to certification, upon the issuance of an administrative letter.

    The State Board of Tax Commissioners intends to amend 50 IAC 2.3 by making minor corrections and clarifications to Exhibit 1 of the 2002 Real Property Assessment Manual, the Real Property Assessment Guidelines for 2002 Version A, which was incorporated by reference in the rule. The contemplated amendments are not considered to be of major significance, but are necessary to minimize potential confusion and uncertainty regarding the application of portions of the guidelines. The State Board of Tax Commissioners invites written suggestions, facts, arguments, or views in these matters.     Amends 105 IAC 5-10-1 concerning the criteria of a petition for the opening of a railroad crossing. It deletes the requirement that a petitioner that is granted waiver for flashing lights must bear the cost of installing lights at a different crossing. The rule will also amend 105 IAC 5-10-1 and 105 IAC 5-10-2 in order to make other technical changes.     Amends 50 IAC 2.3-1-1 to extend the date that county assessors may select and publish a specific set of guidelines to be used for the assessment of real property for the 2002 general reassessment.

  • Title 105 Indiana Department of Transportation -- #01-374 (PDF)

    Amends 105 IAC 9-4 concerning current categories for business logo signs and adds qualifications for a new category of business logo signs. It will also add a fee for seasonal installation and removal of closed panels, a requirement of compliance checks and notice of violations, and the consideration of available space when locating signs. The rule will also make other substantive and technical changes for spacing requirements for signs and will establish a timeframe for conformance with the spacing requirements.

    Amends 329 IAC 3.1-1-7 to achieve consistency with federal hazardous waste management regulations by incorporating by reference changes to the federal hazardous waste management regulations at 40 CFR 260 through 40 CFR 270, published in the Federal Register from July 10, 2000, through May 16, 2001. Amends 329 IAC 3.1-7-2 to be consistent with IC 13-22-4-3.1 by removing a provision that requires generators to enter waste handling codes on the Uniform Hazardous Waste Manifest. Amends 329 IAC 3.1-9-2 and 329 IAC 3.1-10-2 to be consistent with Public Law 143-2000 by removing provisions that require permitted treatment, storage, and disposal facilities to send copies of hazardous waste manifests to IDEM. Repeals 329 IAC 3.1-4-9.1 and 329 IAC 3.1-4-17.1.

    Amends 872 IAC 1-1-8 to change the experience requirements for certified public accountants to bring the requirements into conformity with statutory changes by changing the types of experience required before a certificate or license may be issued. Amends 872 IAC 1-1-8.3 to require a licensee to verify an applicant's experience to meet the requirements of IC 25-2.1-3-10. Amends 872 IAC 1-1-8.4 to revise the use of an advanced degree as experience. Amends 872 IAC 1-1-10 to revise the fee schedule for certificate of registration for CPAs, PAs, and APs and for firm permits. Repeals 872 IAC 1-1-8.1.

    The Indiana Department of Environmental Management (IDEM) is soliciting public comment on amendments to 326 IAC 6-1-10.1 to revise the particulate matter emission limits at U.S. Steel-Gary Works. IDEM seeks comment on the affected citations listed and any other provisions of Title 326 that may be affected by this rulemaking.

    The Indiana Department of Environmental Management (IDEM) is soliciting public comment on new rules concerning compliance monitoring requirements for sources that are required to obtain operating permits, and a new section in the general provisions rule (326 IAC 1-1) concerning types of data that can be used in enforcement actions, in response to the United States Environmental Protection Agency's 1997 final rule (62 FR 8314) concerning credible evidence revisions. IDEM is also proposing technical corrections to rules at 326 IAC 3 and 326 IAC 7 concerning emissions monitoring requirements, source sampling procedures and testing, and reporting requirements for monitoring system malfunctions. If needed, this rulemaking may also include changes required by U.S. EPA to obtain approval of 326 IAC 3 into the state implementation plan.
