  • Title 11 Consumer Protection Division of the Office of the Attorney General -- #02-18 (PDF)

    Adds 11 IAC 2-2-5 concerning information provided to consumers added to the telephone privacy list. Amends 11 IAC 2-5-1, 11 IAC 2-5-2, and 11 IAC 2-5-3 by obligating the division to remove certain numbers from the telephone privacy list. Adds 11 IAC 2-5-4 providing for annual purging of the telephone privacy list.

  • Title 11 Consumer Protection Division of the Office of the Attorney General -- #02-19 (PDF)

    Adds 11 IAC 2-9 to provide that residential telephone numbers shall remain on the telephone privacy list in the event of a change of area code or prefix, or both. Provides that the telephone privacy list shall contain both numbers so long as a telephone solicitor may reach the consumer by directly dialing either number.

    Adds 130 IAC 2, 130 IAC 3, and 130 IAC 4 to establish rules concerning applicability and definitions, traffic control, and port use. Repeals 130 IAC 1.

  • Title 312 Natural Resources Commission -- #01-412 (PDF)

    Amends 312 IAC 8 that governs public use of DNR properties to make several changes. Included is a definition of "public road" to conform to the definition of "public highway" in IC 9-25-2-4. New definitions would be added for snowmobile, off-road vehicle, and vehicle. The prohibition would be eliminated on the possession of firearms at public access sites maintained by the division of fish and wildlife. Quiet time at campsites would be extended one hour from 6 a.m. to 7 a.m. Pets would be required to be attended at all times. Vehicles could be left in DNR parking lots only while using a DNR property or adjacent public freshwater lake or navigable waterway. The receipt and pass requirement for horses would be eliminated, but the tag requirement would be retained.

    Amends 345 IAC 2-6-8 to clarify exemptions to certificates of veterinary inspection requirements for cattle sold intrastate. Under IC 4-22-2-37.1, IC 14- 22-2-6, IC 14-10-2-5, and IC 14-22-6-13 (applicable to state parks), the director of the department of natural resources adopts the emergency rule set forth in this document. The emergency rule is adopted with the awareness the regulation of wild animals in Indiana is the responsibility of the department of natural resources, and with a heightened awareness of that responsibility (as well as a responsibility for the welfare of flora and other fauna), within Indiana state parks and dedicated nature preserves. More particularly, based upon the opinion of professional biologists, the director has determined: (A) white-tailed deer have caused, and will continue to cause, obvious and measurable damage to the ecological balance within these properties; and (B) the ecological balance within these properties will not be maintained unless action is taken to control their populations. Examples of damages caused by excessive deer populations include reduction of rare plant species and sampling data that show, more generally, vegetation species disturbance in areas accessible to deer browsing.

    Establish that credit hours taken to comply with the educational requirements in IC 25-2.1-3-2 cannot be duplicated. Add a licensing fee for a letter of verification of a certificate of registration to another state. Revise the examination used for accounting practitioners to comply with IC 25-2.1-6-1. Incorporate by reference the 2001 pronouncements on professional standards of the American Institute of Certified Public Accountants (to apply to certified public accountants) and 2001 rule of professional conduct of the National Society of Public Accountants (to apply to accounting practitioners and public accountants). Establish that continuing professional education hours obtained to renew a lapsed certificate cannot be double counted by using the hours for credit for renewal at the end of the reporting period. Establish the requirements for substantial equivalency.     Amends 405 IAC 5-19-1 to clarify the definition of medical and surgical supplies. The amendments provide restrictions and limitations for coverage, and provide that reimbursement shall be equal to the lower of the provider's submitted charges or the Medicaid allowable amount for each item. The amendments require that all medical supplies be billed using health care financing administration common procedure coding system in accordance with the instructions set forth in the Indiana health coverage programs manual or update bulletins.
