EXECUTIVE ORDER: 24-03

FOR: POSTPONING THE EXPIRATION OF CERTAIN ADMINISTRATIVE RULES

TO ALL TO WHOM THESE PRESENTS MAY COME, GREETINGS:

WHEREAS, on September 18, 2023, I authorized the Indiana Department of Insurance to proceed with a proposed provisional rule under IC 4-22-2-37.1 concerning the Indiana all payer claims database;

WHEREAS, in so doing, I found that the proposed provisional rule was necessary to avoid an imminent and substantial violation of IC 27-1-44.5, as an emergency rule adopted in June 2023 to implement that chapter was set to expire on September 23, 2023 before a final rule could take effect;

WHEREAS, the proposed provisional rule became LSA Document #23-678 ("IDOI Provisional Rule"), effective September 23, 2023, and temporarily added a rule concerning the Indiana all payer claims database and otherwise implementing IC 27-1-44.5;

WHEREAS, the IDOI Provisional Rule expires March 21, 2024, and a final rule implementing IC 27-1-44.5, though close to being finalized, will not be completed prior to that date; and

WHEREAS, IC 4-22-2.3-2 provides that, before a provisional rule expires, the Governor may, by executive order, authorize the extension of the provisional rule under the interim procedures described in IC 4-22-2-37.2, if the Governor determines and finds that the provisional circumstances justifying the provisional rule continue to exist:
